Article 2 Relationship between this Convention and other agreements and legal Instruments 1. In or der to bet ter pro tect hu man he alth, Par ti es are en co u ra ged to imp le ment me a su res be y ond tho se re qu i red by this Con ven ti on and its pro to cols, and not hing in the se inst ru ments shall pre vent a Party from im po sing stric ter re qu i re ments that are con sis tent with the ir pro vi si ons and are in ac cor dan ce with in ter na ti o nal law. 2. The pro vi si ons of the Con ven ti on and its pro to cols shall in no way af fect the right of Par ti es to en ter into bi la te ral or mul ti la te ral ag re e ments, inc lu ding re gi o nal or sub re gi o nal ag re e ments, on is su es re le vant or ad di ti o nal to the Con ven ti on and its pro to cols, pro vi ded that such ag re e ments are com pa tib le with the ir ob li ga ti ons un der the Con ven ti on and its pro to cols. The Par ti es con cer ned shall com mu ni ca te such ag re e ments to the Con fe ren ce of the Par ti es thro ugh the Sec re ta ri at. 1 Whe re app rop ri a te, na ti o nal will re fer equ ally to re gi o nal eco no mic integration or ga ni za ti ons.

4 1078 M A G Y A R K Ö Z L Ö N Y 2005/28. szám PART II OBJECTIVE, GUIDING PRINCIPLES AND GENERAL OBLIGATIONS Article 3 Objective The ob jec ti ve of this Con ven ti on and its pro to cols is to pro tect pre sent and fut ure ge ne ra ti ons from the de vas tat ing he alth, so ci al, en vi ron men tal and eco no mic con se qu en ces of to bac co con sump ti on and ex po su re to to bac co smo ke by pro vi ding a fra me work for to bac co cont rol me a su res to be imp le men ted by the Par ti es at the na ti o nal, re gi o nal and in ter na ti o nal le vels in or der to re du ce con ti nu ally and subs tan ti ally the pre va len ce of to bac co use and ex po su re to to bac co smo ke. Article 4 Guiding principles To achi e ve the ob jec ti ve of this Con ven ti on and its pro to cols and to imp le ment its pro vi si ons, the Par ti es shall be gu i ded, in ter alia, by the prin cip les set out be low: 1. Eve ry per son sho uld be in for med of the he alth con se qu en ces, ad dic ti ve na tu re and mor tal thre at po sed by to bac co con sump ti on and ex po su re to to bac co smo ke and ef fec ti ve le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve or ot her me a su res sho uld be con temp la ted at the app rop ri a te go vern men tal le vel to pro tect all per sons from ex po su re to to bac co smo ke. 2. Strong po li ti cal com mit ment is ne ces sa ry to de ve lop and sup port, at the na ti o nal, re gi o nal and in ter na ti o nal le vels, comp re hen si ve mul ti sec to ral me a su res and co or di na ted res pon ses, ta king into con si de ra ti on: (a) the need to take me a su res to pro tect all per sons from ex po su re to to bac co smo ke; (b) the need to take me a su res to pre vent the ini ti a ti on, to pro mo te and sup port ces sa ti on, and to dec re a se the con sump ti on of to bac co pro ducts in any form; (c) the need to take me a su res to pro mo te the par ti ci pa ti on of in di ge no us in di vi du als and com mu ni ti es in the de ve lop ment, imp le men ta ti on and eva lu a ti on of to bac co cont rol pro gram mes that are so ci ally and cul tu rally app rop ri a te to the ir ne eds and pers pec ti ves; and (d) the need to take me a su res to add ress gen der-spe ci fic risks when de ve lo ping to bac co cont rol stra te gi es. 3. In ter na ti o nal co o pe ra ti on, par ti cu larly trans fer of tech no logy, know led ge and fi nan ci al as sis tan ce and pro vi si on of re la ted ex per ti se, to es tab lish and imp le ment ef fec ti ve to bac co cont rol pro gram mes, ta king into con si de ra ti on lo cal cul tu re, as well as so ci al, eco no mic, po li ti cal and le gal fac tors, is an im por tant part of the Con ven ti on. 4. Comp re hen si ve mul ti sec to ral me a su res and res pon ses to re du ce con sump ti on of all to bac co pro ducts at the na ti o nal, re gi o nal and in ter na ti o nal le vels are es sen ti al so as top re vent, in ac cor dan ce with pub lic he alth prin cip les, the in ci den ce of di se a ses, pre mat ure di sa bi lity and mor ta lity due to to bac co con sump ti on and ex po su re to to bac co smo ke. 5. Is su es re lat ing to li a bi lity, as de ter mi ned by each Party wit hin its ju ris dic ti on, are an im por tant part of comp re hen si ve to bac co cont rol. 6. The im por tan ce of tech ni cal and fi nan ci al as sis tan ce to aid the eco no mic tran si ti on of to bac co gro wers and wor kers who se li ve li ho ods are se ri o usly af fec ted as a con se qu en ce of to bac co cont rol pro gram mes in de ve lo ping co unt ry Par ti es, as well as Par ti es with eco no mi es in tran si ti on, sho uld be re cog ni zed and add res sed in the con text of na ti o nally de ve lo ped stra te gi es for sus ta i nab le de ve lop ment. 7. The par ti ci pa ti on of ci vil so ci ety is es sen ti al in achi e ving the ob jec ti ve of the Con ven ti on and its pro to cols. Article 5 General obligations 1. Each Party shall de ve lop, imp le ment, pe ri o di cally up da te and re vi ew comp re hen si ve mul ti sec to ral na ti o nal to bac co cont rol stra te gi es, plans and pro gram mes in ac cor dan ce with this Con ven ti on and the pro to cols to which it is a Party. 2. To wards this end, each Party shall, in ac cor dan ce with its ca pa bi li ti es: (a) es tab lish or re in for ce and fi nan ce a na ti o nal co or di na ting me cha nism or fo cal po ints for to bac co cont rol; and (b) adopt and imp le ment ef fec ti ve le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve and/or ot her me a su res and co o pe ra te, as app rop ri a te, with ot her Par ti es in de ve lo ping app rop ri a te po li ci es for pre ven ting and re du cing to bac co con sump ti on, ni co ti ne ad dic ti on and ex po su re to to bac co smo ke. 3. In set ting and imp le men ting the ir pub lic he alth po li ci es with res pect to to bac co cont rol, Par ti es shall act to pro tect the se po li ci es from com mer ci al and ot her ves ted in ter ests of the to bac co in dust ry in ac cor dan ce with na ti o nal law. 4. The Par ti es shall co o pe ra te in the for mu lat ion of pro po sed me a su res, pro ce du res and gu i de li nes for the

The Par ti es shall co o pe ra te, as app rop ri a te, with com pe tent in ter na ti o nal and re gi o nal in ter go vern men tal or ga ni za ti ons and ot her bo di es to achi e ve the ob jec ti ves of the Con ven ti on and the pro to cols to which they are Par ti es. 6. The Par ti es shall, wit hin me ans and re so ur ces at the ir dis po sal, co o pe ra te to ra i se fi nan ci al re so ur ces for ef fec ti ve imp le men ta ti on of the Con ven ti on thro ugh bi la te ral and mul ti la te ral fun ding me cha nisms. PART III MEASURES RELATING TO THE REDUCTION OF DEMAND FOR TOBACCO Article 6 Price and tax measures to reduce the demand for tobacco 1. The Par ti es re cog ni ze that pri ce and tax me a su res are an ef fec ti ve and im por tant me ans of re du cing to bac co con sump ti on by va ri o us seg ments of the po pu la ti on, in par ti cu lar yo ung per sons. 2. Wit ho ut pre ju di ce to the so ve re ign right of the Par ti es to de ter mi ne and es tab lish the ir ta xa ti on po li ci es, each Party sho uld take ac co unt of its na ti o nal he alth ob jec ti ves con cer ning to bac co cont rol and adopt or ma in ta in, as app rop ri a te, me a su res which may inc lu de: (a) imp le men ting tax po li ci es and, whe re app rop ri a te, pri ce po li ci es, on to bac co pro ducts so as to cont ri bu te to the he alth ob jec ti ves ai med at re du cing to bac co con sump ti on; and (b) pro hi bi ting or rest ric ting, as app rop ri a te, sa les to and/or im por ta ti ons by in ter na ti o nal tra vel lers of tax- and duty-free to bac co pro ducts. 3. The Par ti es shall pro vi de ra tes of ta xa ti on for to bac co pro ducts and trends in to bac co con sump ti on in the ir pe ri o dic re ports to the Con fe ren ce of the Par ti es, in ac cor dan ce with Ar tic le 21. Article 7 Non-price measures to reduce the demand for tobacco The Par ti es re cog ni ze that comp re hen si ve non-pri ce me a su res are an ef fec ti ve and im por tant me ans of re du cing to bac co con sump ti on. Each Party shall adopt and imp le ment ef fec ti ve le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve or ot her me a su res ne ces sa ry to imp le ment its ob li ga ti ons pur su ant to Ar tic les 8 to 13 and shall co o pe ra te, as app rop ri a te, with each ot her di rectly or thro ugh com pe tent in ter na ti o nal bo di es with a view to the ir imp le men ta ti on. The Con fe ren ce of the Par ti es shall pro po se app rop ri a te gu i de li nes for the imp le men ta ti on of the pro vi si ons of the se Ar tic les. Article 8 Protection from exposure to tobacco smoke 1. Par ti es re cog ni ze that sci en ti fic evi den ce has une qu i vo cally es tab lis hed that ex po su re to to bac co smo ke ca u ses de ath, di se a se and di sa bi lity. 2. Each Party shall adopt and imp le ment in are as of exis ting na ti o nal ju ris dic ti on as de ter mi ned by na ti o nal law and ac ti vely pro mo te at ot her ju ris dic ti o nal le vels the adop ti on and imp le men ta ti on of ef fec ti ve le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve and/or ot her me a su res, pro vi ding for pro tec ti on from ex po su re to to bac co smo ke in in do or workp la ces, pub lic trans port, in do or pub lic pla ces and, as app rop ri a te, ot her pub lic pla ces. Article 9 Regulation of the contents of tobacco products The Con fe ren ce of the Par ti es, in con sul ta ti on with com pe tent in ter na ti o nal bo di es, shall pro po se gu i de li nes for test ing and me a su ring the con tents and emis si ons of to bac co pro ducts, and for the re gu lat ion of the se con tents and emis si ons. Each Party shall, whe re app ro ved by com pe tent na ti o nal aut ho ri ti es, adopt and imp le ment ef fec ti ve le gis la ti ve, exe cu ti ve and ad mi nist ra ti ve or ot her me a su res for such test ing and me a su ring, and for such re gu lat ion. Article 10 Regulation of tobacco product disclosures Each Party shall, in ac cor dan ce with its na ti o nal law, adopt and imp le ment ef fec ti ve le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve or ot her me a su res re qu i ring ma nu fac tu rers and im port ers of to bac co pro ducts to disc lo se to go vern men tal aut ho ri ti es in for mat ion abo ut the con tents and emis si ons of to bac co pro ducts. Each Party shall furt her adopt and imp le ment ef fec ti ve me a su res for pub lic disc lo su re of in for mat ion abo ut the to xic cons ti tu ents of the to bac co pro ducts and the emis si ons that they may pro du ce.

Each Party shall, wit hin a pe ri od of three ye ars af ter ent ry into for ce of this Con ven ti on for that Party, adopt and imp le ment, in ac cor dan ce with its na ti o nal law, ef fec ti ve me a su res to en su re that: (a) to bac co pro duct pac ka ging and la bel ling do not pro mo te a to bac co pro duct by any me ans that are fal se, mis le a ding, de cep ti ve or li kely to cre a te an er ro ne o us imp res si on abo ut its cha rac te ris tics, he alth ef fects, ha zards or emis si ons, inc lu ding any term, desc rip tor, tra de mark, fi gu ra ti ve or any ot her sign that di rectly or in di rectly cre a tes the fal se imp res si on that a par ti cu lar to bac co pro duct is less harm ful than ot her to bac co pro ducts. The se may inc lu de terms such as low tar, light, ult ra-light, or mild ; and (b) each unit pac ket and pac ka ge of to bac co pro ducts and any out si de pac ka ging and la bel ling of such pro ducts also car ry he alth war nings desc ri bing the harm ful effects of to bac co use, and may inc lu de ot her app rop ri a te messages. The se war nings and mes sa ges: (i) shall be app ro ved by the com pe tent na ti o nal aut ho rity, (ii) shall be ro ta ting, (iii) shall be lar ge, cle ar, vi sib le and le gib le, (iv) sho uld be 50% or more of the prin ci pal disp lay are as but shall be no less than 30% of the prin ci pal disp lay are as, (v) may be in the form of or inc lu de pic tu res or pic tog rams. 2. Each unit pac ket and pac ka ge of to bac co pro ducts and any out si de pac ka ging and la bel ling of such pro ducts shall, in ad di ti on to the war nings spe ci fi ed in pa rag raph 1(b) of this Ar tic le, con ta in in for mat ion on re le vant constituents and emis si ons of to bac co pro duct as de fi ned by na ti o nal aut ho ri ti es. 3. Each Party shall re qu i re that the war nings and ot her tex tu al in for mat ion spe ci fi ed in pa rag raphs 1(b) and paragraph 2 of this Ar tic le will ap pe ar on each unit pac ket and pac ka ge of to bac co pro ducts and any out si de packaging and la bel ling of such pro ducts in its prin ci pal lan gu a ge or lan gu a ges. 4. For the pur po ses of this Ar tic le, the term out si de pac ka ging and la bel ling in re lat ion to to bac co pro ducts app li es to any pac ka ging and la bel ling used in the re ta il sale of the pro duct. Article 12 Education, communication, training and public awareness Each Party shall pro mo te and strengt hen pub lic awareness of to bac co cont rol is su es, using all ava i lab le com mu ni ca ti on to ols, as app rop ri a te. To wards this end, each Party shall adopt and imp le ment ef fec ti ve le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve or ot her me a su res to pro mo te: (a) bro ad ac cess to ef fec ti ve and comp re hen si ve edu ca ti o nal and pub lic awa re ness pro gram mes on the he alth risks inc lu ding the ad dic ti ve cha rac te ris tics of to bac co con sump ti on and ex po su re to to bac co smo ke; (b) pub lic awa re ness abo ut the he alth risks of to bac co con sump ti on and ex po su re to to bac co smo ke, and abo ut the be ne fits of the ces sa ti on of to bac co use and to bac co-free li festy les as spe ci fi ed in Ar tic le 14.2; (c) pub lic ac cess, in ac cor dan ce with na ti o nal law, to a wide rang e of in for mat ion on the to bac co in dust ry as re le vant to the ob jec ti ve of this Con ven ti on; (d) ef fec ti ve and app rop ri a te tra i ning or sen si ti za ti on and awa re ness pro gram mes on to bac co cont rol add res sed to per sons such as he alth wor kers, com mu nity wor kers, so ci al wor kers, me dia pro fes si o nals, edu ca tors, de ci si on-ma kers, ad mi nist ra tors and ot her con cer ned per sons; (e) awa re ness and par ti ci pa ti on of pub lic and pri va te agen ci es and non go vern men tal or ga ni za ti ons not af fi li a ted with the to bac co in dust ry in de ve lo ping and imp le men ting in ter sec to ral pro gram mes and stra te gi es for to bac co cont rol; and (f) pub lic awa re ness of and ac cess to in for mat ion re gar ding the ad ver se he alth, eco no mic, and en vi ron men tal con se qu en ces of to bac co pro duc ti on and con sump ti on. Article 13 Tobacco advertising, promotion and sponsorship 1. Par ti es re cog ni ze that a comp re hen si ve ban on ad ver ti sing, pro mo ti on and spon sors hip wo uld re du ce the con sump ti on of to bac co pro ducts. 2. Each Party shall, in ac cor dan ce with its cons ti tu ti on or cons ti tu ti o nal prin cip les, un der ta ke a comp re hen si ve ban of all to bac co ad ver ti sing, pro mo ti on and spon sors hip. This shall inc lu de, sub ject to the le gal en vi ron ment and tech ni cal me ans ava i lab le to that Party, a comp re hen si ve ban on cross-bor der ad ver ti sing, pro mo ti on and spon sors hip ori gi na ting from its ter ri to ry. In this res pect, wit hin the pe ri od of five ye ars af ter ent ry into for ce of this Con ven ti on for that Party, each Party shall un der ta ke app rop ri a te le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve and/or ot her me a su res and re port ac cor dingly in con for mity with Ar tic le A Party that is not in a po si ti on to un der ta ke a comp re hen si ve ban due to its cons ti tu ti on or cons ti tu ti o nal prin cip les shall apply rest ric ti ons on all to bac co ad ver ti sing, pro mo ti on and spon sors hip. In this res pect, each Party shall un der ta ke app rop ri a te le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve and/or ot her me a su res and re port ac cor dingly in con for mity with Ar tic le As a mi ni mum, and in ac cor dan ce with its cons ti tu ti on or cons ti tu ti o nal prin cip les, each Party shall: (a) pro hi bit all forms of to bac co ad ver ti sing, pro mo ti on and spon sors hip that pro mo te a to bac co pro duct by any me ans that are fal se, mis le a ding or de cep ti ve or li kely to cre a te an er ro ne o us imp res si on abo ut its cha rac te ris tics, he alth ef fects, ha zards or emis si ons; (b) re qu i re that he alth or ot her app rop ri a te war nings or mes sa ges ac com pany all to bac co ad ver ti sing and, as app rop ri a te, pro mo ti on and spon sors hip; (c) rest rict the use of di rect or in di rect in cen ti ves that en co u ra ge the pur cha se of to bac co pro ducts by the pub lic; (d) re qu i re, if it does not have a comp re hen si ve ban, the disc lo su re to re le vant go vern men tal aut ho ri ti es of ex pen di tu res by the to bac co in dust ry on ad ver ti sing, pro mo ti on and spon sors hip not yet pro hi bi ted. Tho se aut ho ri ti es may de ci de to make tho se fi gu res ava i lab le, sub ject to na ti o nal law, to the pub lic and to the Con fe ren ce of the Par ti es, pur su ant to Ar tic le 21; (e) un der ta ke a comp re hen si ve ban or, in the case of a Party that is not in a po si ti on to un der ta ke a comp re hen si ve ban due to its cons ti tu ti on or cons ti tu ti o nal prin cip les, rest rict to bac co ad ver ti sing, pro mo ti on and spon sors hip on ra dio, te le vi si on, print me dia and, as app rop ri a te, ot her me dia, such as the in ter net, wit hin a pe ri od of five ye ars; and (f) pro hi bit, or in the case of a Party that is not in a po si ti on to pro hi bit due to its cons ti tu ti on or cons ti tu ti o nal prin cip les rest rict, to bac co spon sors hip of in ter na ti o nal events, ac ti vi ti es and/or par ti ci pants the re in. 5. Par ti es are en co u ra ged to imp le ment me a su res be y ond the ob li ga ti ons set out in pa rag raph Par ti es shall co o pe ra te in the de ve lop ment of tech no lo gi es and ot her me ans ne ces sa ry to fa ci li ta te the eli mi na ti on of cross-bor der ad ver ti sing. 7. Par ti es which have a ban on cer ta in forms of to bac co ad ver ti sing, pro mo ti on and spon sors hip have the so ve re ign right to ban tho se forms of cross-bor der to bac co ad ver ti sing, pro mo ti on and spon sors hip en te ring the ir ter ri to ry and to im po se equ al pe nal ti es as tho se app li cab le to do mes tic ad ver ti sing, pro mo ti on and spon sors hip ori gi na ting from the ir ter ri to ry in ac cor dan ce with the ir na ti o nal law. This pa rag raph does not en dor se or app ro ve of any par ti cu lar pe nalty. 8. Par ti es shall con si der the ela bo ra ti on of a pro to col set ting out app rop ri a te me a su res that re qu i re in ter na ti o nal col la bo ra ti on for a comp re hen si ve ban on cross-bor der ad ver ti sing, pro mo ti on and spon sors hip. Article 14 Demand reduction measures concerning tobacco dependence and Cessation 1. Each Party shall de ve lop and dis se mi na te app rop ri a te, comp re hen si ve and in teg ra ted gu i de li nes ba sed on sci en ti fic evi den ce and best prac ti ces, ta king into ac co unt na ti o nal cir cums tan ces and pri o ri ti es, and shall take ef fec ti ve me a su res to pro mo te ces sa ti on of to bac co use and ade qu a te tre at ment for to bac co de pen den ce. 2. To wards this end, each Party shall en de a vo ur to: (a) de sign and imp le ment ef fec ti ve pro gram mes ai med at pro mo ting the ces sa ti on of to bac co use, in such lo ca ti ons as edu ca ti o nal ins ti tu ti ons, he alth care fa ci li ti es, workp la ces and sport ing en vi ron ments; (b) inc lu de di ag no sis and tre at ment of to bac co de pen den ce and co un sel ling ser vi ces on ces sa ti on of to bac co use in na ti o nal he alth and edu ca ti on pro gram mes, plans and stra te gi es, with the par ti ci pa ti on of he alth wor kers, com mu nity wor kers and so ci al wor kers as app rop ri a te; (c) es tab lish in he alth care fa ci li ti es and re ha bi li ta ti on cent res pro gram mes for di ag no sing, co un sel ling, pre ven ting and tre a ting to bac co de pen den ce; and (d) col la bo ra te with ot her Par ti es to fa ci li ta te ac ces si bi lity and af for da bi lity for tre at ment of to bac co de pen den ce inc lu ding phar ma ce u ti cal pro ducts pur su ant to Ar tic le 22. Such pro ducts and the ir cons ti tu ents may inc lu de me di ci nes, pro ducts used to ad mi nis ter me di ci nes and di ag nos tics when app rop ri a te. PART IV MEASURES RELATING TO THE REDUCTION OF THE SUPPLY OF TOBACCO Article 15 Illicit trade in tobacco products 1. The Par ti es re cog ni ze that the eli mi na ti on of all forms of il li cit tra de in to bac co pro ducts, inc lu ding smugg ling, il li cit ma nu fac tu ring and co un ter fe i ting, and the de ve lop ment and imp le men ta ti on of re la ted na ti o nal law, in ad di ti on to sub re gi o nal, re gi o nal and glo bal ag re e ments, are es sen ti al com po nents of to bac co cont rol.

In ad di ti on, each Party shall: (a) re qu i re that unit pac kets and pac ka ges of to bac co pro ducts for re ta il and who le sa le use that are sold on its do mes tic mar ket car ry the sta te ment: Sa les only al lo wed in (in sert name of the co unt ry, sub na ti o nal, re gi o nal or fe de ral unit) or car ry any ot her ef fec ti ve mar king in di ca ting the fi nal des ti na ti on or which wo uld as sist aut ho ri ti es in de ter mi ning whet her the pro duct is le gally for sale on the do mes tic mar ket; and (b) con si der, as app rop ri a te, de ve lo ping a prac ti cal trac king and tra cing re gi me that wo uld furt her se cu re the dist ri bu ti on sys tem and as sist in the in ves ti ga ti on of il li cit tra de. 3. Each Party shall re qu i re that the pac ka ging in for mat ion or mar king spe ci fi ed in pa rag raph 2 of this Ar tic le shall be pre sen ted in le gib le form and/or ap pe ar in its prin ci pal lan gu a ge or lan gu a ges. 4. With a view to eli mi na ting il li cit tra de in to bac co pro ducts, each Party shall: (a) mo ni tor and col lect data on cross-bor der tra de in to bac co pro ducts, inc lu ding il li cit tra de, and ex chan ge in for mat ion among cus toms, tax and ot her aut ho ri ti es, as app rop ri a te, and in ac cor dan ce with na ti o nal law and re le vant app li cab le bi la te ral or mul ti la te ral ag re e ments; (b) enact or strengt hen le gis la ti on, with app rop ri a te pe nal ti es and re me di es, aga inst il li cit tra de in to bac co pro ducts, inc lu ding co un ter fe it and cont ra band ci ga ret tes; (c) take app rop ri a te steps to en su re that all con fis ca ted ma nu fac tu ring equ ip ment, co un ter fe it and cont ra band ci ga ret tes and ot her to bac co pro ducts are dest ro y ed, using en vi ron men tally-fri endly met hods whe re fe a sib le, or dis po sed of in ac cor dan ce with na ti o nal law; (d) adopt and imp le ment me a su res to mo ni tor, do cu ment and cont rol the sto ra ge and dist ri bu ti on of to bac co pro ducts held or mo ving un der sus pen si on of ta xes or du ti es wit hin its ju ris dic ti on; and (e) adopt me a su res as app rop ri a te to enab le the con fis ca ti on of pro ce eds de ri ved from the il li cit tra de in to bac co pro ducts. 5. In for mat ion col lec ted pur su ant to sub pa rag raphs 4(a) and 4(d) of this Ar tic le shall, as app rop ri a te, be pro vi ded in agg re ga te form by the Par ti es in the ir pe ri o dic re ports to the Con fe ren ce of the Par ti es, in ac cor dan ce with Ar tic le The Par ti es shall, as app rop ri a te and in ac cor dan ce with na ti o nal law, pro mo te co o pe ra ti on bet we en na ti o nal agen ci es, as well as re le vant re gi o nal and in ter na ti o nal in ter go vern men tal or ga ni za ti ons as it re la tes to in ves ti ga ti ons, pro se cu ti ons and pro ce e dings, with a view to eli mi na ting il li cit tra de in to bac co pro ducts. Spe ci al emp ha sis shall be pla ced on co o pe ra ti on at re gi o nal and sub re gi o nal le vels to com bat il li cit tra de of to bac co pro ducts. 7. Each Party shall en de a vo ur to adopt and imp le ment furt her me a su res inc lu ding li cen sing, whe re app rop ri a te, to cont rol or re gu la te the pro duc ti on and dist ri bu ti on of to bac co pro ducts in or der to pre vent il li cit tra de. Article 16 Sales to and by minors 1. Each Party shall adopt and imp le ment ef fec ti ve le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve or ot her me a su res at the app rop ri a te go vern ment le vel to pro hi bit the sa les of to bac co pro ducts to per sons un der the age set by do mes tic law, na ti o nal law or eigh te en. The se me a su res may inc lu de: (a) re qu i ring that all sel lers of to bac co pro ducts pla ce a cle ar and pro mi nent in di ca tor in si de the ir po int of sale abo ut the pro hi bi ti on of to bac co sa les to mi nors and, in case of do ubt, re qu est that each to bac co pur cha ser pro vi de app rop ri a te evi den ce of ha ving re a ched full le gal age; (b) ban ning the sale of to bac co pro ducts in any man ner by which they are di rectly ac ces sib le, such as sto re shel ves; (c) pro hi bi ting the ma nu fac tu re and sale of swe ets, snacks, toys or any ot her ob jects in the form of to bac co pro ducts which ap pe al to mi nors; and (d) en su ring that to bac co ven ding ma chi nes un der its ju ris dic ti on are not ac ces sib le to mi nors and do not pro mo te the sale of to bac co pro ducts to mi nors. 2. Each Party shall pro hi bit or pro mo te the pro hi bi ti on of the dist ri bu ti on of free to bac co pro ducts to the pub lic and es pe ci ally mi nors. 3. Each Party shall en de a vo ur to pro hi bit the sale of ci ga ret tes in di vi du ally or in small pac kets which inc re a se the af for da bi lity of such pro ducts to mi nors. 4. The Par ti es re cog ni ze that in or der to inc re a se the ir ef fec ti ve ness, me a su res to pre vent to bac co pro duct sa les to mi nors sho uld, whe re app rop ri a te, be imp le men ted in con junc ti on with ot her pro vi si ons con ta i ned in this Con ven ti on. 5. When sig ning, ra ti fy ing, ac cep ting, app ro ving or ac ce ding to the Con ven ti on or at any time the re af ter, a Party may, by me ans of a bin ding writ ten dec la ra ti on, in di ca te its com mit ment to pro hi bit the int ro duc ti on of

Each Party shall adopt and imp le ment ef fec ti ve le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve or ot her me a su res, inc lu ding pe nal ti es aga inst sel lers and dist ri bu tors, in or der to en su re comp li an ce with the ob li ga ti ons con ta i ned in pa rag raphs 1 5 of this Ar tic le. 7. Each Party sho uld, as app rop ri a te, adopt and imp le ment ef fec ti ve le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve or ot her me a su res to pro hi bit the sa les of to bac co pro ducts by per sons un der the age set by do mes tic law, na ti o nal law or eigh te en. Article 17 Provision of support for economically viable alternative activities Par ti es shall, in co o pe ra ti on with each ot her and with com pe tent in ter na ti o nal and re gi o nal in ter go vern men tal or ga ni za ti ons, pro mo te, as app rop ri a te, eco no mi cally vi ab le al ter na ti ves for to bac co wor kers, gro wers and, as the case may be, in di vi du al sel lers. exis ting laws, whe re ne ces sa ry, to deal with cri mi nal and ci vil li a bi lity, inc lu ding com pen sa ti on whe re app rop ri a te. 2. Par ti es shall co o pe ra te with each ot her in ex chan ging in for mat ion thro ugh the Con fe ren ce of the Par ti es in ac cor dan ce with Ar tic le 21 inc lu ding: (a) in for mat ion on the he alth ef fects of the con sump ti on of to bac co pro ducts and ex po su re to to bac co smo ke in ac cor dan ce with Ar tic le 20.3(a); and (b) in for mat ion on le gis la ti on and re gu lat ions in for ce as well as per ti nent ju risp ru den ce. 3. The Par ti es shall, as app rop ri a te and mu tu ally ag re ed, wit hin the li mits of na ti o nal le gis la ti on, po li ci es, le gal prac ti ces and app li cab le exis ting tre aty ar ran ge ments, af ford one anot her as sis tan ce in le gal pro ce e dings re lat ing to ci vil and cri mi nal li a bi lity con sis tent with this Con ven ti on. 4. The Con ven ti on shall in no way af fect or li mit any rights of ac cess of the Par ti es to each ot her s co urts whe re such rights exist. 5. The Con fe ren ce of the Par ti es may con si der, if pos sib le, at an early sta ge, ta king ac co unt of the work be ing done in re le vant in ter na ti o nal fora, is su es re la ted to li a bi lity inc lu ding app rop ri a te in ter na ti o nal app ro a ches to the se is su es and app rop ri a te me ans to sup port, upon re qu est, the Par ti es in the ir le gis la ti ve and ot her ac ti vi ti es in ac cor dan ce with this Ar tic le. PART V PROTECTION OF THE ENVIRONMENT Article 18 Protection of the environment and the health of persons In car ry ing out the ir ob li ga ti ons un der this Con ven ti on, the Par ti es ag ree to have due re gard to the pro tec ti on of the en vi ron ment and the he alth of per sons in re lat ion to the en vi ron ment in res pect of to bac co cul ti va ti on and ma nu fac tu re wit hin the ir res pec ti ve ter ri to ri es. PART VI QUESTIONS RELATED TO LIABILITY Article 19 Liability 1. For the pur po se of to bac co cont rol, the Par ti es shall con si der ta king le gis la ti ve ac ti on or pro mo ting the ir PART VII SCIENTIFIC AND TECHNICAL COOPERATION AND COMMUNICATION OF INFORMATION Article 20 Research, surveillance and exchange of information 1. The Par ti es un der ta ke to de ve lop and pro mo te na ti o nal re se arch and to co or di na te re se arch pro gram mes at the re gi o nal and in ter na ti o nal le vels in the fi eld of to bac co cont rol. To wards this end, each Party shall: (a) ini ti a te and co o pe ra te in, di rectly or thro ugh com pe tent in ter na ti o nal and re gi o nal in ter go vern men tal or ga ni za ti ons and ot her bo di es, the con duct of re se arch and sci en ti fic as sess ments, and in so do ing pro mo te and en co u ra ge re se arch that add res ses the de ter mi nants and con se qu en ces of to bac co con sump ti on and ex po su re to to bac co smo ke as well as re se arch for iden ti fi ca ti on of al ter na ti ve crops; and (b) pro mo te and strengt hen, with the sup port of com pe tent in ter na ti o nal and re gi o nal in ter go vern men tal or ga ni za ti ons and ot her bo di es, tra i ning and sup port for all tho se en ga ged in to bac co cont rol ac ti vi ti es, inc lu ding re se arch, imp le men ta ti on and eva lu a ti on.

Par ti es re cog ni ze the im por tan ce of fi nan ci al and tech ni cal as sis tan ce from in ter na ti o nal and re gi o nal in ter go vern men tal or ga ni za ti ons and ot her bo di es. Each Party shall en de a vo ur to: (a) es tab lish prog res si vely a na ti o nal sys tem for the epi de mi o lo gi cal sur ve il lan ce of to bac co con sump ti on and re la ted so ci al, eco no mic and he alth in di ca tors; (b) co o pe ra te with com pe tent in ter na ti o nal and re gi o nal in ter go vern men tal or ga ni za ti ons and ot her bo di es, inc lu ding go vern men tal and non go vern men tal agen ci es, in re gi o nal and glo bal to bac co sur ve il lan ce and ex chan ge of in for mat ion on the in di ca tors spe ci fi ed in pa rag raph 3(a) of this Ar tic le; and (c) co o pe ra te with the World He alth Or ga ni za ti on in the de ve lop ment of ge ne ral gu i de li nes or pro ce du res for de fi ning the col lec ti on, analy sis and dis se mi na ti on of to bac co-re la ted sur ve il lan ce data. 4. The Par ti es shall, sub ject to na ti o nal law, pro mo te and fa ci li ta te the ex chan ge of pub licly ava i lab le sci en ti fic, tech ni cal, so ci o e co no mic, com mer ci al and le gal in for mat ion, as well as in for mat ion re gar ding prac ti ces of the to bac co in dust ry and the cul ti va ti on of to bac co, which is re le vant to this Con ven ti on, and in so do ing shall take into ac co unt and add ress the spe ci al ne eds of de ve lo ping co unt ry Par ti es and Par ti es with eco no mi es in tran si ti on. Each Party shall en de a vo ur to: (a) prog res si vely es tab lish and ma in ta in an up da ted da ta ba se of laws and re gu lat ions on to bac co cont rol and, as app rop ri a te, in for mat ion abo ut the ir en for ce ment, as well as per ti nent ju risp ru den ce, and co o pe ra te in the de ve lop ment of pro gram mes for re gi o nal and glo bal to bac co cont rol; (b) prog res si vely es tab lish and ma in ta in up da ted data from na ti o nal sur ve il lan ce pro gram mes in ac cor dan ce with pa rag raph 3(a) of this Ar tic le; and (c) co o pe ra te with com pe tent in ter na ti o nal or ga ni za ti ons to prog res si vely es tab lish and ma in ta in a glo bal sys tem to re gu larly col lect and dis se mi na te in for mat ion on to bac co pro duc ti on, ma nu fac tu re and the ac ti vi ti es of the to bac co in dust ry which have an im pact on the Con ven ti on or na ti o nal to bac co cont rol ac ti vi ti es. 5. Par ti es sho uld co o pe ra te in re gi o nal and in ter na ti o nal in ter go vern men tal or ga ni za ti ons and fi nan ci al and de ve lop ment ins ti tu ti ons of which they are mem bers, to pro mo te and en co u ra ge pro vi si on of tech ni cal and fi nan ci al re so ur ces to the Sec re ta ri at to as sist de ve lo ping co unt ry Par ti es and Par ti es with eco no mi es in tran si ti on to meet the ir com mit ments on re se arch, sur ve il lan ce and ex chan ge of in for mat ion. Article 21 Reporting and exchange of information 1. Each Party shall sub mit to the Con fe ren ce of the Par ti es, thro ugh the Sec re ta ri at, pe ri o dic re ports on its imp le men ta ti on of this Con ven ti on, which sho uld inc lu de the fol lo wing: (a) in for mat ion on le gis la ti ve, exe cu ti ve, ad mi nist ra ti ve or ot her me a su res ta ken to imp le ment the Con ven ti on; (b) in for mat ion, as app rop ri a te, on any const ra ints or bar ri ers en co un te red in its imp le men ta ti on of the Con ven ti on, and on the me a su res ta ken to over co me the se barriers; (c) in for mat ion, as app rop ri a te, on fi nan ci al and tech ni cal as sis tan ce pro vi ded or re ce i ved for to bac co cont rol ac ti vi ti es; (d) in for mat ion on sur ve il lan ce and re se arch as spe ci fi ed in Ar tic le 20; and (e) in for mat ion spe ci fi ed in Ar tic les 6.3, 13.2, 13.3, 13.4(d), 15.5 and The fre qu en cy and for mat of such re ports by all Par ti es shall be de ter mi ned by the Con fe ren ce of the Par ti es. Each Party shall make its ini ti al re port wit hin two ye ars of the ent ry into for ce of the Con ven ti on for that Party. 3. The Con fe ren ce of the Par ti es, pur su ant to Ar tic les 22 and 26, shall con si der ar ran ge ments to as sist de ve lo ping co unt ry Par ti es and Par ti es with eco no mi es in tran si ti on, at the ir re qu est, in me e ting the ir ob li ga ti ons un der this Ar tic le. 4. The re port ing and ex chan ge of in for mat ion un der the Con ven ti on shall be sub ject to na ti o nal law re gar ding con fi den ti a lity and pri va cy. The Par ti es shall pro tect, as mu tu ally ag re ed, any con fi den ti al in for mat ion that is ex chan ged. Article 22 Cooperation in the scientific, technical, and legal fields and provision of related expertise 1. The Par ti es shall co o pe ra te di rectly or thro ugh com pe tent in ter na ti o nal bo di es to strengt hen the ir ca pa city to ful fill the ob li ga ti ons ari sing from this Con ven ti on, ta king into ac co unt the ne eds of de ve lo ping co unt ry Par ti es and Par ti es with eco no mi es in tran si ti on. Such co o pe ra ti on shall pro mo te the trans fer of tech ni cal, sci en ti fic and le gal ex per ti se and tech no logy, as mu tu ally

11 2005/28. szám M A G Y A R K Ö Z L Ö N Y 1085 ag re ed, to es tab lish and strengt hen na ti o nal to bac co cont rol stra te gi es, plans and pro gram mes ai ming at, in ter alia: (a) fa ci li ta ti on of the de ve lop ment, trans fer and ac qu i si ti on of tech no logy, know led ge, skills, ca pa city and ex per ti se re la ted to to bac co cont rol; (b) pro vi si on of tech ni cal, sci en ti fic, le gal and ot her ex per ti se to es tab lish and strengt hen na ti o nal to bac co cont rol stra te gi es, plans and pro gram mes, ai ming at imp le men ta ti on of the Con ven ti on thro ugh, in ter alia: (i) as sis ting, upon re qu est, in the de ve lop ment of a strong le gis la ti ve fo un da ti on as well as tech ni cal pro gram mes, inc lu ding tho se on pre ven ti on of ini ti a ti on, pro mo ti on of ces sa ti on and pro tec ti on from ex po su re to to bac co smo ke; (ii) as sis ting, as app rop ri a te, to bac co wor kers in the de ve lop ment of app rop ri a te eco no mi cally and le gally vi ab le al ter na ti ve li ve li ho ods in an eco no mi cally vi ab le man ner; and (iii) as sis ting, as app rop ri a te, to bac co gro wers in shif ting ag ri cul tu ral pro duc ti on to al ter na ti ve crops in an eco no mi cally vi ab le man ner; (c) sup port for app rop ri a te tra i ning or sen si ti za ti on pro gram mes for app rop ri a te per son nel in ac cor dan ce with Ar tic le 12; (d) pro vi si on, as app rop ri a te, of the ne ces sa ry ma te ri al, equ ip ment and supp li es, as well as lo gis ti cal sup port, for to bac co cont rol stra te gi es, plans and pro gram mes; (e) iden ti fi ca ti on of met hods for to bac co cont rol, inc lu ding comp re hen si ve tre at ment of ni co ti ne ad dic ti on; and (f) pro mo ti on, as app rop ri a te, of re se arch to inc re a se the af for da bi lity of comp re hen si ve tre at ment of ni co ti ne ad dic ti on. 2. The Con fe ren ce of the Par ti es shall pro mo te and fa ci li ta te trans fer of tech ni cal, sci en ti fic and le gal ex per ti se and tech no logy with the fi nan ci al sup port se cu red in ac cor dan ce with Ar tic le 26. PART VIII INSTITUTIONAL ARRANGEMENTS AND FINANCIAL RESOURCES Article 23 Conference of the Parties 1. A Con fe ren ce of the Par ti es is he re by es tab lis hed. The first ses si on of the Con fe ren ce shall be con ve ned by the World He alth Or ga ni za ti on not la ter than one year af ter the ent ry into for ce of this Con ven ti on. The Con fe ren ce will de ter mi ne the ve nue and ti ming of sub se qu ent re gu lar ses si ons at its first ses si on. 2. Ext ra or di na ry ses si ons of the Con fe ren ce of the Par ti es shall be held at such ot her ti mes as may be de e med ne ces sa ry by the Con fe ren ce, or at the writ ten re qu est of any Party, pro vi ded that, wit hin six months of the re qu est be ing com mu ni ca ted to them by the Sec re ta ri at of the Con ven ti on, it is sup por ted by at le ast one-third of the Parties. 3. The Con fe ren ce of the Par ti es shall adopt by con sen sus its Ru les of Pro ce du re at its first ses si on. 4. The Con fe ren ce of the Par ti es shall by con sen sus adopt fi nan ci al ru les for it self as well as go ver ning the fun ding of any sub si di a ry bo di es it may es tab lish as well as fi nan ci al pro vi si ons go ver ning the func ti o ning of the Sec re ta ri at. At each or di na ry ses si on, it shall adopt a bud get for the fi nan ci al pe ri od un til the next or di na ry session. 5. The Con fe ren ce of the Par ti es shall keep un der re gu lar re vi ew the imp le men ta ti on of the Con ven ti on and take the de ci si ons ne ces sa ry to pro mo te its ef fec ti ve imp le men ta ti on and may adopt pro to cols, an ne xes and amend ments to the Con ven ti on, in ac cor dan ce with Ar tic les 28, 29 and 33. To wards this end, it shall: (a) pro mo te and fa ci li ta te the ex chan ge of in for mat ion pur su ant to Ar tic les 20 and 21; (b) pro mo te and gu i de the de ve lop ment and pe ri o dic re fi ne ment of com pa rab le met ho do lo gi es for re se arch and the col lec ti on of data, in ad di ti on to tho se pro vi ded for in Ar tic le 20, re le vant to the imp le men ta ti on of the Con ven ti on; (c) pro mo te, as app rop ri a te, the de ve lop ment, imp le men ta ti on and eva lu a ti on of stra te gi es plans, and pro gram mes, as well as po li ci es, le gis la ti on and ot her me a su res; (d) con si der re ports sub mit ted by the Par ti es in ac cor dan ce with Ar tic le 21 and adopt re gu lar re ports on the imp le men ta ti on of the Con ven ti on; (e) pro mo te and fa ci li ta te the mo bi li za ti on of fi nan ci al re so ur ces for the imp le men ta ti on of the Con ven ti on in ac cor dan ce with Ar tic le 26; (f) es tab lish such sub si di a ry bo di es as are ne ces sa ry to achi e ve the ob jec ti ve of the Con ven ti on; (g) re qu est, whe re app rop ri a te, the ser vi ces and co o pe ra ti on of, and in for mat ion pro vi ded by, com pe tent and re le vant or ga ni za ti ons and bo di es of the Uni ted Na ti ons sys tem, and ot her in ter na ti o nal and re gi o nal in ter go vern men tal or ga ni za ti ons and non go vern men tal or ga ni za ti ons and bo di es as a me ans of strengt he ning the imp le men ta ti on of the Con ven ti on; and (h) con si der ot her ac ti on, as app rop ri a te, for the achi e ve ment of the ob jec ti ve of the Con ven ti on in the light of ex pe ri en ce ga i ned in its imp le men ta ti on. 6. The Con fe ren ce of the Par ti es shall es tab lish the cri te ria for the par ti ci pa ti on of ob ser vers at its pro ce e dings.
