(a szabad mozgás és tartózkodás jogával rendelkező személyek beutazásáról és tartózkodásáról szóló évi I. törvény végrehajtásáról szóló 113/2007. (V. 24.) Korm. rendelet), which took effect on 1 st July There are a number pf gaps and inconformities in the transposition that touch upon the following: entry conditions follow a formal approach in the transposing legislation, with regard to residence right in general, the most burdensome issue is the definition of becoming an unreasonable burden, the transposing instrument set strict conditions for the verification of entitlement, one of the major issues of the transposition concerns the situation of family members, and especially the non-hungarian family members of Hungarian s, there are a number of unconformities with regard to the registration procedure, rules on expulsion are burdensome, if for nothing else, but because they allow the expulsion of permanent residents, without linking it to public policy considerations, the transposing articles allow the expulsion of permanent residents with very tight time-schedule, there are no sufficient guarantees that previous criminal conviction is not taken into account and that expulsion will not serve a general preventive aim, finally, judicial review and redress is in general very restricted in the FMA. Effective transposition The FMA defines the spouses of EEA s and those of Hungarian s. This double definition matches the further logic and the further structure of the law. A general comment on the logic of the FMA: it extends the free movement right regime to family members of Hungarian s, without specifying that the couple should have exercised the free movement right previously. Therefore the wording is not precise prima faciae, but if read in conjunction with the purpose of the law (Free movement Act), it is supposed not to refer to wholly internal situations. Same-sex marriages are currently not covered by Hungarian legislation, since according to the Constitution, the marriage exists between a man and a woman. However, a same-sex partner may prove the residence entitlement by invoking to be a member of the household, or from 1 st January 2009 onwards, claiming the registered partner status. (see

However, Act CLXXXIV of 2007 on registered partnership will enter into force on 1 st January This Act will make it possible for two major persons (above 18), present in front of the registrar to declare that they wish to establish a registered partnership. Effective transposition Direct descendants of the spouse are covered, since registered partnership is not yet recognised under Hungarian law. (see: art. 2.2 (b)) Incorrect transposition Direct ascendants of Hungarian s and of their spouses are covered, however the condition of being dependent is added to ascendants of EEA and Hungarian s. This creates a positive discrimination with regard to ascendants of Hungarian s, which is not in line with the objective of the Directive. No direct Y Indirect conformity

Beneficiaries This Directive shall apply to all Union citizens who move to or reside in a Member State other than that of which they are a, and to their family members as defined in point 2 of Article 2 who accompany or join them. Effective transposition The FMA defines the beneficiaries in four cathegories, namely - EEA s - family members of the EEA (without soecifying their country of origin) - family members of Hungarian s (who are not themselves Hungarian, thus, EEA and third country s as well are covered) - the dependants of the EEA and Hungarian s, of whom the EEA and Hungarian s take care of for serious health reasons and those who were member of their household for at least one year. (to this point see art. 3.2.) In the case of family members, the FMA mentions the fact of joining or accompanying the EEA and Hungarian s. The whereabouts of the prior common residence are not prescribed, therefore the country where the family comes from might be from within the EU or outside the EU.

Though, the Directive does not specify any criteria, what to understand by being a member of

Article 8 (1) The competent authority may authorise residence for a person as a family member if: a) said person is a dependant of a Hungarian, or has lived in the same household as a Hungarian for at least one year, or is cared for in person by a Hungarian upon serious health grounds; b) said person was a dependant of an EEA, or lived in the same household as an EEA for at least one year, in the country from which they arrive, or who is cared for in person by an EEA upon serious health grounds, where the EEA fulfils the conditions in Article 6(1). the household of the Union Citizen, therefore paragraph (3) of article 3 of the FMA introduces the criterion for verification of having lived together for at least one year prior to claim the right of residence. In the case of EEA s, this period shall be satisfied prior to arrival therefore this condition excludes those who get under the same roof once having arrived to Hungary. In that case, the situation of those third country partners who are not married to the EEA prior to arrival or who have not lived together for one year in an other Member State, is problematic, (After arrival, the partnership that lasts for one year can not be recognised, since registered partnership is not yet recognised under Hungarian law.) The fact of prior cohabitation needs to be proven (pursuant to 8(2) of the FMA) by a document stating the common residence in the previous country of residence. See Article 8 of the Directive for further assessment. Regarding Hungarian s, the whereabouts of the cohabitation of one year is not specified, therefore there might be positive discrimination based on purely internal situations as well, since the partner of the Hungarian can claim his/her residence right even without a previous exercise of the free movement right with the Hungarian in an other country, lasting for one year. Article 3. The existence of conditions set forth by paragraphs (1)-(4) of article 4 of the FMA is controlled by border patrols prior to entering the territory of Hungary. Article 36 (1) The authority entitled to control the border movements is entitled to deny entry of the EEA and of the family member if they do not meet the entry criteria set forth Milieu Ltd HUNGARY 11/114 Y Incorrect The wording of the FMA is more positive as regards the facilitation of entry and residence as required by the Directive since it says directly, are entitled to enter. However, account must be taken of Comment under Article 5(2) of the Directive, where conditions prove the contrary of the facilitated entry. Indirect transposition Art. 3(3) of the FMA says (text reproduced under art. 3(2) a) of the Directive) one year of cohabitation is needed to prove that a relationship is durable. The said article of the FMA refers to members of the household, which is defined separately by art. 1. d) of the IGD, which does not specify partners, but is intended to cover persons who live under the same roof, who have the same address or domicile as the Hungarian or EEA. Partners, registered partners thus fall under the scope of application of this article. Incorrect transposition This only refers to the entry of family members and the check regarding their travel documents and where applicable, their visas. The wording does not mention the control of other personal circumstances. Article 36 of the FMA specifies the denial procedure, however does not set sufficient guarantees for persons whose right to entry is denied, since

RIGHT OF EXIT AND ENTRY Art. 4.1 Right of Exit Without prejudice to the s on travel documents applicable to border controls, all Union citizens with a valid identity card or passport and their family members who are not s of a Member State and who hold a valid passport shall have the right to leave the territory of a Member State to travel to another Member State. Appeal against the decision is not possible. Article 1. (1) Leaving the territory of the Republic of Hungary including the right to leave the country with the intention to settle down abroad is a fundamental constitutional right. Are entitled to benefit from this right all Hungarian citizens and foreigners residing legally in the country. The right to travel abroad can be exercised and its exercise can be limited according to the conditions set forth by this Law. (3) The right to travelling abroad might be exercised in possession of a valid travel document. When entering and crossing the territory of a country which is signatory to the EEA Agreement, Hungarian citizens may exercise their right to travel abroad in possession of an ID card, as well as wehen and inter treaty provides for Milieu Ltd HUNGARY 12/114 N, Imprecise appeal is not possible against a redirection decision. This article of the FMA sends back to article 3 of the same act that lays down the documents with which the beneficiaries might enter the territory of Hungary (full text reproduced under art. 5(1) of the Directive). Art. 3 of the FMA does not mention residence in the text, only entry, however the title of chapter II of the FMA entitles Right of Entry and residence, so the missing mention in article 3 should cover the residence right as well by virtue of the title. Imprecise transposition This article applies to Hungarian s and foreigners residing legally in the country, thus including EEA s as well. Paragraph (3) of the same article specifies that the right to leave the country can be exercised in possession of a valid passport or identity card. However, right of exit is granted for those who reside legally in Hungary. The wording is misleading; it leaves to understand that exit is not possible if the residence is illegal. This might affect family members, who are third country s.

Article 3 (1) EEA citizens with a valid travel document or personal identity card are entitled to enter the territory of the Republic of Hungary. (2) A family member with the ity of a third country accompanying an EEA or Y Y Y N, Incomplet e Effective transposition There is no corresponding in the FMA or in the IGD that no exit visa might be asked for, however the direct applicability of the Schengen Border Code ensures conformity to this regard. Effective transposition Hungarian passports issued by the Central Registrar of the Ministry of Interior contain the ity of its holder. All Hungarian s aged over 14 must have an ID card as well, that states their identity and this document is renewed automatically when it comes to expiration pursuant to Government Decree 168/1999 (XI. 24). Effective transposition Hungarian passports are valid for all countries of the world and are issued with a validity of five or ten years according to the request of the citizen. (art. 8 of the act) Incomplete transposition The FMA defines those entitled to enter the territory of the Republic of Hungary in two sequences, first the EEA s, then the third country family members accompanying or joining the Hungarian or the EEA

Hungarian or joining an EEA or Hungarian residing on the territory of the Republic of Hungary shall be entitled to enter the territory of the Republic of Hungary with a valid travel document and, unless otherwise provided for in directly applicable European Community law or by inter agreement, a valid visa. Article 3 (4) Persons defined in paragraphs (2) and (3) may enter the territory of the Republic of Hungary without a visa if they have a document proving the right of residence under this Act, or a residence card issued to them as a family member of an EEA, having the ity of a third country, by a signatory state to the Agreement on the European Economic Area. Milieu Ltd HUNGARY 14/114 Y Y residing in the country, however the Directive does not require that the EU citizen is residing in the host MS., Therefore further examination is needed in practice to see whether authorities grant leave to enter for example when the family member arrives alone and expressis verbis does not join the primary beneficiary of residence. Effective transposition The FMA does not contain a specific on entry visas or equivalent formalities for Union citizens, but paragraph (1) of article 3 of the FMA established that EEA s can enter the country with a valid passport or identity card. Furthermore, the direct applicability of the Schengen border code ensures conformity. Effective transposition Conformity with the first sentence of the Directive is established by article 3(2) of the FMA, which sets forth as a general rule the application of laws, entailing the possession of a valid entry visa, unless otherwise provided for by directly applicable, binding community legislation. Although Regulation 539/2001 is not expressly mentioned, it falls in the category of directly applicable, binding community legislation thus will have priority over rules.

Such visas shall be issued free of charge as soon as possible and on the basis of an accelerated procedure. Article 73 (1) In proceedings relating to the issue of visas, any costs for translation, interpreting and sign-language interpreting (hereinafter mother-tongue costs) shall be borne by the applicant; Costs of each procedure 1. Costs of visa applications 1.4. The cost of application for entry visa of the family member of a Hungarian, falling under the scope of application of the FMA is 60 Euros. Milieu Ltd HUNGARY 15/114 Incorrect Article 3(4) of the FMA is in line with the second part of the article of the Directive, where the FMA states that third country family members may enter the territory without a visa. The FMA links the condition of entering the territory of Hungary without a visa to having a document proving the right of residence under this Act. This is a reference to articles 22 (1) and 24 (1) of the FMA, which lay down the rules for documents for stays exceeding three months (residence card) and the documents verifying a permanent recidence right (permanent residence card). Here, the FMA intends to establish conformity with the second part of article 5 (2) of the Directive. Incorrect transposition There is no facilitation in obtaining the visa, as it is prescribed by article 5(2) of the directive, since for example paragraph (6) of article 20 of the FMA states that the right of appeal is not granted for those whose visa is not granted. Furthermore, paragraph (1) of article 73 of the FMA states that the applicant must bear the costs of interpretation and interpretation in the procedure of issuing the visa. There is no mention in the FMA that the visa shall be issued free of charge, hence point 1.4 of annex II. of the TAD foresees the payment of 60 euros for family members of a Hungarian who are

(1) A vízum kivételes esetben kiadható a Magyar Köztársaság közúti, légi, valamint vízi határátkelőhelyén (a továbbiakban: határátkelőhely) is, feltéve, hogy a harmadik ország állampolgárságával rendelkező családtag megfelel a Tv. 4. (1) bekezdése szerinti feltételeknek, és valószínűsíti, hogy nem volt abban a helyzetben, hogy előzetesen vízumot igényelhessen. (2) A határátkelőhelyen előterjesztett vízum iránti kérelmet a Határőrség köteles elektronikus úton haladéktalanul döntésre felterjeszteni a Hivatalhoz. (3) A Hivatal a kérelemről a kézhezvételt követően azonnal, de legkésőbb három órán belül határoz, és döntését - a Határőrség útján - elektronikus úton közli a kérelmezővel. (4) A vízummal kapcsolatos ügyintézés folyamatossága érdekében a Hivatal állandó ügyeleti szolgálatot szervez. (5) A kérelemnek helyt adó döntés esetén a vízumot a Határőrség állítja ki a kérelmező részére. Article 7. (1) Under special circumstances visas may be issued at road, air and water border crossing points of the Republic of Hungary (hereinafter referred to as "border crossing points") to family members who are thirdcountry s, provided that they are able to satisfy the requirements set out in Subsection (1) of Section 4 of the FMA, and if able to verify that they were prevented from obtaining a visa in advance. (2) The Border Guard shall forward visa applications submitted at border crossing points by way of electronic means without delay to the Office. (3) The Office shall promptly adopt a decision concerning the aforesaid applications, not to exceed three hours, and shall notify the applicant of its decision - via the Border Guard - electronically. (4) The Office shall operate a non-stop customer service department to ensure the continuity of visa services. (5) If the application is approved, the visa shall be issued to the applicant by the Milieu Ltd HUNGARY 16/114 themselves third country s benefiting from the right of free movement when applying for the entry visa. The problem with the above quoted fee set forth by the TAD is that it applies to third country family members of a Hungarian regardless of the fact whether the Hungarian citizen already exercised his/her right to free movement or not. If so (i.e. the Hungarian was previously a migrant), than there is discrimination between third country family members of Hungarian citizens and those of other EU citizens. Points c) and d) of article 1(1) of the FMA (text reproduced under 3.1) militate in favour of this interpretation, since these points define the scope of application of the Act suggesting that those family members are covered, who accompany or join the Hungarian citizen. In this case, it is not necessary that the couple be established previously in an EU country (thus that the third country family member would have received his/her visa in that country), but they might have establisdhed their union in a third country once the Hungarian has already been an intra-community migrant). In such case, more favourable Community s (equal treatment) should apply to the family member of the previously migrant

(2) A vízum iránti kérelem az utazás tervezett időpontját legfeljebb három hónappal megelőzően terjeszthető elő. (3) A vízum iránti kérelem előterjesztésekor a kérelmezőnek be kell mutatnia érvényes úti okmányát. Az úti okmánynak - a 13. -ban foglalt kivétellel - legalább egy, a vízum beillesztésére szolgáló szabad lapot kell tartalmaznia. (4) A vízum iránti kérelemhez mellékelni kell a tartózkodás célját igazoló okiratokat. (5) A vízumkiadó hatóság a tartózkodás teljes időtartamára, valamint a vissza- vagy továbbutazáshoz szükséges anyagi fedezet meglétét vélelmezi. 10. A vízum iránti kérelem benyújtásakor a vízumkiadó Border Guard. Article 8. (1) With the exception set out in Subsection (2), visa applications may be submitted to any consulate officer of Hungary, or to the foreign mission of any nation that is authorized to accept visa applications in the name and on behalf of the Republic of Hungary or any other place authorized to accept such applications. (2) Where Section 7 applies, visa applications shall be submitted at the border crossing point. Article 9. (2) Visa applications may be submitted within three months prior to the planned date of travel. (3) When lodging the visa applications the applicant shall present his/her valid travel document. The travel document - with the exception set out in Section 13 - must have at least one suitable page where the visa can be installed. (4) Documents that justify the purpose of intended stay shall be attached to the visa application. (5) Visa authorities shall presume the availability of financial means necessary for the entire duration of stay, or for the return or continued travel. Article 10. Whenever a visa application is submitted, the Milieu Ltd HUNGARY 17/114 Hungarain, which is not the case according to the present wording of the TAD, because it does not differentiate between migrant Hungarians and sedantery Hungarians third country family members and imposes on both category the payment of a 60 euros fee. Furthermore, the FMA does not set forth any requirement for an accelerated procedure; the quoted articles of the IGD only specify the general deadlines for dealing with visa applications which are the following: if an application for entry visa is made at road, air and water border crossing points, the application shall be dealt with within 3 hours, however when an application is made at the foreign mission, the application shall be dealt with within 15 days. (If the National Security Agency needs to be contacted, than the deadline is prolongated by ten days.) A positive in the IGD, that is in line with the obligation to facilitate the obtention of the entry visa is that the authorities have to presume the existence of the necessary financial resources of the applicant. The separate sheet referred to in Article 13 of the IGD refers to a specific procedural rule, namely: If the Republic of Hungary refuses to recognize the travel document of a

(1) Ha a vízumkötelezett harmadik ország állampolgárságával rendelkező családtag úti okmányát a Magyar Köztársaság nem ismeri el, a vízumot az e rendelet 2. mellékletének 2. pontja szerinti formában és adattartalommal, vízum beillesztésére szolgáló űrlapon (a továbbiakban: külön lap) kell kiadni, feltéve, hogy a kérelmező eleget tesz a személyek határátlépésére irányadó szabályok közösségi kódexének létrehozásáról szóló március 15-i 562/2006/EK európai parlamenti és tanácsi rendelet 5. cikk (1) bekezdés c) és e) pontjában foglalt feltételeknek. (2) Az (1) bekezdés rendelkezései megfelelően alkalmazandók abban az esetben is, ha a vízumkötelezett harmadik competent visa authority - or the competent body of the Border Guard under Section 7 -shall record it in the form of an entry in the applicant's travel document along with the place and date where and when it was submitted, the code of the visa requested, and the name of the authority receiving the application. Article 11.The competent consulate officer shall adopt a decision concerning visa applications within fifteen days from the time of receipt. Article 13. (1) If the Republic of Hungary refuses to recognize the travel document of a thirdcountry family member who is subject to a visa requirement, a visa shall be issued in the form and with the content specified in Point 2 of Schedule No. 2 to this Decree on a form for affixing a visa (hereinafter referred to as "separate sheet"), provided that the person in question meets the requirements set out in Article 5 (1) c) and e) of Regulation (EC) No. 562/2006 of the European Parliament and of the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders. (2) The s contained in Subsection (1) shall also apply if Milieu Ltd HUNGARY 18/114 third-country family member who is subject to a visa requirement, a visa shall be issued in the form and with the content specified in Point 2 of Schedule No. 2 to this Decree on a form for affixing a visa (hereinafter referred to as "separate sheet"), provided that the person in question meets the requirements set out in Article 5 (1) c) and e) of Regulation (EC) No. 562/2006 of the European Parliament and of the Council of 15 March 2006 establishing a Community Code on the rules governing the movement of persons across borders. This procedural rule aims to facilitate further administrative proceedings.

Article 14 IGD; 14. (1) A külpolitikáért felelős miniszter, valamint a konzuli tisztviselő a vízum iránti kérelemről a Nemzetbiztonsági Hivatal véleményét kérheti. (2) A Nemzetbiztonsági Hivatal köteles a megkeresésnek tíz napon belül eleget tenni. Article 14.(1) The minister in charge of foreign policies and the competent consulate officer may request the opinion of the National Security Agency concerning any visa application. (2) The National Security Agency shall provide the aforesaid opinion within ten days. Article 17 IGD; and 17. (1) A központi vízumhatóság Tv.-ben meghatározott feladatát a Hivatal látja el. (2) A Hivatal megkeresi az egyeztetést kérő schengeni államok központi hatóságait, nyilatkozzanak arra nézve, hogy a vízum kiadásához hozzájárulnake. (3) Ha a megkeresett központi hatóságok bármelyike részéről nemleges válasz érkezik, a Hivatal legfeljebb korlátozott területi érvényességű vízum kiadásához járulhat hozzá. (4) Ha a megkeresett központi hatóságtól a megkeresés részére történt továbbításától számított hét napon vagy a meghosszabbított határidőn belül nem érkezik Article 17. (1) The tasks, as defined by law of the central visa authority are carried out by the Office. (2) The Office will contact the central authorities of the States asking for cross-checking to know if they approve the issue of the visa or not. (3) If the any of the contacted authorities does not approve the request, the Office can only approve the visa with limited territorial scope. (4) If no answer is received from the requested central authority within seven days counting from the notification to the said authority or within the prolonged term, than the approval needs to be presumed. (5) A megkeresett központi hatóság a válaszadás határidejét meghosszabbíthatja. A Hivatal erről tájékoztatja a konzuli tisztviselőt vagy a vízum iránti kérelem tekintetében eljáró más szervet. (5) The requested central authority can prolong the term of answering. In such case, the Office notifies the consular officer or the other authority dealing with the visa application. Article 18 of the IGD 18. (1) Ha valamely schengeni állam központi hatóságának a vízum iránti kérelemre vonatkozó döntés meghozatala előtt - a Tv. 86. (6) bekezdése alapján kiadott miniszteri rendelet szerint - a Hivatallal egyeztetnie kell, a Hivatal legkésőbb a megkeresés részére történt továbbításától számított hét napon belül köteles nyilatkozni arról, hogy a vízum kiadásához hozzájárul-e. (2) Ha az ügy különösen bonyolult jellege szükségessé teszi, a Hivatal a megkereső schengeni állam központi hatóságától a válaszadási határidő meghosszabbítását kérheti. A határidő meghosszabbítása iránti kérelmet indokolni kell. (3) A központi vízumhatóság az egyeztetés során történő válaszadás előtt köteles a vízumkérelemről a Nemzetbiztonsági Hivatal véleményét kérni. (4) A Nemzetbiztonsági Hivatal köteles a központi vízumhatóság megkeresésének hét napon belül eleget tenni. Article 18. (1) If prior to taking a decision on the issue of the visa, a central authority of a Schengen State needs to contact the Office according to the Ministerial Decree adopted on the basis of article 6 of the Act I of , the Office needs to notify within seven days, counting from the date of the request being transmitted to it, whether it approves or not the issue of the visa. (2) If the complicated nature of the case makes it necessary, the Office might ask from the central authority of the requesting Schengen State the prolongation of the answering period. Such request for prolongation shall be reasoned. (3) The Office needs to ask for the position of the Agency for National Security before answering to the request for issuing a visa.
