II. DEFINITIONS APPLICABLES IN THE GENERAL TERMS AND II. AZ A LTALA NOS SZERZO DE SI FELTE TELEKBEN HASZNA LT FOGALMAK CONDITIONS 2.1 Le gi utas: az Euro pai Unio ban lako hellyel rendelkezo Utas, akit jelen A ltala nos Szerzo de si Felte telek III. 3.2 a.) b.) vagy c.) pontjaiban meghata rozottak szerint ka r e rt, e s aki a 261/2004 EK rendelet 7. cikke szerinti ka rtalani ta s ira nti ko vetele se t (tova bbiakban: Ko vetele s) a PannonHitelre ki va nja engedme nyezni. 2.2 Le gita rsasa g: a Le gi utas a ltal megadott informa cio alapja n a 261/2004 EK rendelet 7. cikke szerint ka rtalani ta s megfizete se re ko telezett ja ratot u zemelteto le gifuvarozo. 2.3 Engedme nyeze si szerzo de s: A Le gi utas e s a PannonHitel ko zo tt le trejo tt ko vetele sva sa rla si szerzo de s, amely alapja n a Le gi utas a 261/2004 EK rendelet 7. cikke alapja n fenna llo Ko vetele se t a PannonHitelre ruha zza a t. 2.1 Air passenger: Means a Passenger who has registered address within the territory of the European Union and who has been inconvenienced according to Section 3.2 a.), b.) or c) of Chapter III. of this General Terms and Conditions and with who PannonHitel has been concluded an Assignment Agreement having as its subject the enforcement of his/her claim on the basis of Article 7. of the Regulation (EC) No 261/2004. 2.2 Airline: Operating air carrier that is obliged to pay compensation according to Article 7. of the Regulation (EC) No 261/2004 on the basis of the information provided by the Air passenger. 2.3 Assignment Agreement: A Claim Purchase Agreement concluded between the Air Passenger and PannonHitel according to which the Air Passenger transfers his/her outstanding claim for compensation to PannonHitel on the basis of Article 7. of the Regulation (EC) No 261/2004. Ja rat to rle se If the Airline offered re-routing to the passengers to their final destination on an alternative flight, and the arrival time of this flight does not exceed the scheduled arrival time of the originally booked flight a) by two hours, in respect of all flights of 1500 kilometres or less; or b) by three hours, in respect of all intra- Community flights (means in the: European Community) of more than 1500 kilometres and for all other flights between or (c) by four hours, in respect of all flights not falling under a) or b) the Airline may reduce the compensation provided in the above indicated Sections by 50 %. b.) THE CONSIDERATION OF THE SERVICES PROVIDED BY FLIGHT REFUND IV. A Ko vetele s ve tela ra t a PannonHitel a ke zhezve telt ko veto 8 munkanapon belu l banki utala ssal megfizeti a Le gi utas re sze re a Le gi utas a ltal elo zetesen megadott banksza mlasza mra to rte no utala ssal. 4.3 A PannonHitel kifejezetten ro gzi ti, hogy a Le gi utas fele kiza ro lag a 4.2 pontban ro gzi tett esetben a ll be ve tela r fizete si ko telezettse ge, az elo teljesi te st, illetve tova bbi o sszegek ma s jogciḿen to rte no kifizete se t a PannonHitel kifejezetten kiza rja. A PannonHitel kifejezetten kiza rja a Le gi utasnak a Le gita rsasa g nem teljesi te se bo l eredo esetleges ka rte ri te si ige nye t. V. A PANNONHITEL E S A LE GI UTAS KO ZO TTI ENGEDME NYEZE SI SZERZO DE S LE TREJO TTE NEK FELTE TELEI 5.1 Regisztra cio 5.1 Registration A Le gi utas a PannonHitellel to rte no engedme nyeze si szerzo de sko te si sza nde ka t a Flight Refund, mint egyu ttmu ko do fu ggo u gyno k a ltal u zemeltetett www.flightrefund.eu ciḿu internetes felu leten to rte no regisztra cio u tja n ko zli. A regisztra cio alkalma val a Le gi utas ko teles e rve nyes e-mail ciḿet megadni. A Le gi utas tudoma sul veszi, hogy jelen A ltala nos Szerzo de si Felte telekben megjelo lt ta je koztata shoz valo joga t kiza ro lag ezen e-mail ciḿ megada sa t ko veto en gyakorolhatja. A Le gi utas tudoma sul veszi, hogy regisztra cio ja csak akkor to rte nik meg, ha a Le gi utas a PannonHitel a ltal ke rt valamennyi adatot megjelo li. A regisztra cio sikeres megto rte nte ro l a PannonHitel a Le gi utas a ltal megadott e- mail ciḿre e rtesi te st (a tova bbiakban: E rtesi te s) ku ld. 4.2 If the Airline pays the total or partly amount of the assigned claim by the Air passenger to PannonHitel in the frame of an out of court arrangement, a legal action or by execution proceeding, the purchase price of the Claim shall be the 70% of the compensation amount paid by the Airline. PannonHitel shall pay the purchase price of the Claim within 8 business days from the receipt of the Claim via bank transfer to the bank account given previously by the Air passenger. 4.2 PannonHitel expressly set out that its payment obligation occurs exclusively in the case indicated in section 4.2 and therefore PannonHitel expressly excludes its prepayment obligation or any other payment obligation under any legal title. PannonHitel expressly excludes the Air passengers eventual claims for damages due to the fact that the Airline does not comply with its payment obligation. V. CONDITIONS OF CONCLUDING THE ASSIGNMENT AGREEMENT BETWEEN PANNONHITEL AND THE AIR PASSENGER The Air Passenger shall communicate his/her intention to conclude the Assignment Agreement with PannonHitel Zrt. by registering on the following website operated by Flight Refund as tied agent: www.flightrefund.eu. With the registration the Air passenger shall give a valid e-mail address. The Air passenger acknowledges that he/she may exercise his/her right for information indicated in this General Terms and Conditions exclusively by providing this e-mail address. The Air Passenger acknowledges that for the validity of the registration he/she shall grant all data required by PannonHitel. OBLIGATION FOR COOPERATION AND INFORMATION, PHASES OF THE ENFORCEMENT OF THE CLAIM 7.1 The Air passenger shall cooperate and give any necessary statement to PannonHitel and Flight Refund as cooperating tied agent during the enforcement of the Claim upon request. 7.2 In the frame of this obligation the Air passenger shall notify PannonHitel especially in the event the Airline communicates him/her in words or in writing any information, or data in connection with the outstanding claim or it performs any obligations thereof. If the Air passenger fails to communicate the above indicated information he/she shall be liable for the damages of PannonHitel resulting from this failure. 7.3 PannonHitel shall inform the Air passenger about the stages of enforcing the Claim as follows. The Air passenger may get information about the actual stage of the Claim s enforcement with logging in the website of www.flightrefund.eu and by giving his/her registered e-mail address and his/her given password. In the event the Airline does not answer to the official letter within 30 days from its receipt, the enforcement of the claim enters to the legal action stage. In this phase PannonHitel submits a request for a payment order of the claim by its legal representative. If this request has been sent the Air passenger may see in his/her own user surface a sign called payment order request submitted and by clicking to this sign he/she may see the details of In the event the Airline submits an appeal, in the phase of the payment order the procedure of the enforcement of the claim enters to the in court proceeding stage. In the event the Airline does not submit an appeal against the payment order, and the payment order becomes final and enforceable PannonHitel calls the Airline for the voluntary compliance. Egyebekben a felek a www.flightrefund.eu internetes felu leten, illetve e-mailben kommunika lnak egyma ssal. 9.4 A PannonHitel kijelenti, hogy az A ltala nos Szerzo de si Felte telei a magyar jogszaba lyoknak mindenben megfelelnek, azok tisztesse gtelen elemet nem tartalmaznak. 8.2 Furthermore PannonHitel is entitled to terminate the Assignment Agreement with immediate effect in the event PannonHitel discovers that the Air Passenger acts against the Airline in his/her own right for the enforcement of the Claim subject to the Assignment Agreement following the conclusion of the Assignment Agreement. Parties agree that in case of serious breach of contract, either party is entitled to enforce a claim for damages against the other party. 8.3 The Assignment agreement shall be considered as terminated if PannonHitel ascertains dependably that the Airline refers to one of the exemption causes rightfully detailed in the Regulation. IX. CLOSING PROVISIONS 9.1 This legal relationship shall be governed by the Hungarian laws, for the legal disputes arising from this contract the Hungarian courts are competent. Parties stipulate the exclusive jurisdiction of the Buda Central District Court (depending on the value of the claim) in case of Air passengers with Hungarian citizenship. If PannonHitel enters into an agreement with non Hungarian Air passenger, the jurisdiction clause of the Council Regulation (EC) No 44/2001 Section 4. shall apply. 9.2 PannonHitel reserves the right to amend these General Terms and Conditions however it shall publish all the amendments on its website. 9.3 The parties communicate with each other in written form. The Air passenger is entitled to send the assignment agreement and its annexes personally, via post or courier to the registered seat of the PannonHitel. Otherwise parties shall communicate with each other via the website www.flight-refund.eu or by e- mail. 9.4 PannonHitel represents that the General Terms and Conditions are in conformity with the Hungarian laws and they do not contain unfair conditions.
