For the pur po ses of this Con ven ti on, the term se a fa rer me ans any per son who is emp lo y ed or is en ga ged or works in any ca pa city on bo ard a ves sel, ot her than a ship of war, or di na rily en ga ged in ma ri ti me na vi ga ti on. 2. In the event of any do ubt whet her any ca te go ri es of per sons are to be re gar ded as se a fa rers for the pur po se of this Con ven ti on, the qu es ti on shall be de ter mi ned in ac cor dan ce with the pro vi si ons of this Con ven ti on by the com pe tent aut ho rity of the Sta te of na ti o na lity or per ma nent re si den ce of such per sons af ter con sul ting with the shi pow ners and se a fa rers or ga ni za ti ons con cer ned.

3 2005/130. szám M A G Y A R K Ö Z L Ö N Y Af ter con sul ting the rep re sen ta ti ve or ga ni za ti ons of fis hing-ves sel ow ners and per sons wor king on bo ard fis hing ves sels, the com pe tent aut ho rity may apply the pro vi si ons of this Con ven ti on to com mer ci al ma ri ti me fis hing. Article 2 ISSUANCE OF SEAFARERS IDENTITY DOCUMENTS 1. Each Mem ber for which this Con ven ti on is in for ce shall is sue to each of its na ti o nals who is a se a fa rer and ma kes an app li ca ti on to that ef fect a se a fa rers iden tity do cu ment con for ming to the pro vi si ons of Ar tic le 3 of this Con ven ti on. 2. Un less ot her wi se pro vi ded for in this Con ven ti on, the is su an ce of se a fa rers iden tity do cu ments may be sub ject to the same con di ti ons as tho se presc ri bed by na ti o nal laws and re gu lat ions for the is su an ce of tra vel do cu ments. 3. Each Mem ber may also is sue se a fa rers iden tity do cu ments re fer red to in pa rag raph 1 to se a fa rers who have been gran ted the sta tus of per ma nent re si dent in its ter ri to ry. Per ma nent re si dents shall in all ca ses tra vel in con for mity with the pro vi si ons of Ar tic le 6, pa rag raph Each Mem ber shall en su re that se a fa rers iden tity do cu ments are is su ed wit ho ut un due de lay. 5. Se a fa rers shall have the right to an ad mi nist ra ti ve ap pe al in the case of a re jec ti on of the ir app li ca ti on. 6. This Con ven ti on shall be wit ho ut pre ju di ce to the ob li ga ti ons of each Mem ber un der in ter na ti o nal ar ran ge ments re lat ing to re fu ge es and sta te less per sons. Article 3 CONTENT AND FORM 1. The se a fa rers iden tity do cu ment co ve red by this Con ven ti on shall con form in its con tent to the mo del set out in An nex I he re to. The form of the do cu ment and the ma te ri als used in it shall be con sis tent with the ge ne ral spe ci fi ca ti ons set out in the mo del, which shall be ba sed on the cri te ria set out be low. Pro vi ded that any amend ment is con sis tent with the fol lo wing pa rag raphs, An nex I may, whe re ne ces sa ry, be amen ded in ac cor dan ce with Ar tic le 8 be low, in par ti cu lar to take ac co unt of tech no lo gi cal de ve lop ments. The de ci si on to adopt the amend ment shall spe ci fy when the amend ment will en ter into ef fect, ta king ac co unt of the need to give Mem bers suf fi ci ent time to make any ne ces sa ry re vi si ons of the ir na ti o nal se a fa rers iden tity do cu ments and procedures. 2. The se a fa rers iden tity do cu ment shall be de sig ned in a simp le man ner, be made of du rab le ma te ri al, with spe ci al re gard to con di ti ons at sea and be machine- readable. The ma te ri als used shall: a) pre vent tam pe ring with the do cu ment or fal si fi ca ti on, as far as pos sib le, and enab le easy de tec ti on of al te ra ti ons; and b) be ge ne rally ac ces sib le to go vern ments at the lo west cost con sis tent with re li ably achi e ving the pur po se set out in a) abo ve. 3. Mem bers shall take into ac co unt any ava i lab le gu i de li nes de ve lo ped by the In ter na ti o nal La bo ur Or ga ni za ti on on stan dards of the tech no logy to be used which will fa ci li ta te the use of a com mon in ter na ti o nal stan dard. 4. The se a fa rers iden tity do cu ment shall be no lar ger than a nor mal pass port. 5. The se a fa rers iden tity do cu ment shall con ta in the name of the is su ing aut ho rity, in di ca ti ons enab ling ra pid con tact with that aut ho rity, the date and pla ce of is sue of the do cu ment, and the fol lo wing sta te ments: a) this do cu ment is a se a fa rers iden tity do cu ment for the pur po se of the Se a fa rers Iden tity Do cu ments Con ven ti on (Re vi sed), 2003, of the In ter na ti o nal La bo ur Or ga ni za ti on; and b) this do cu ment is a stand-alo ne do cu ment and not a pass port. 6. The ma xi mum va li dity of a se a fa rers iden tity do cu ment shall be de ter mi ned in ac cor dan ce with the laws and re gu lat ions of the is su ing Sta te and shall in no case ex ce ed ten ye ars, sub ject to re ne wal af ter the first five ye ars. 7. Par ti cu lars abo ut the hol der inc lu ded in the se a fa rer s iden tity do cu ment shall be rest ric ted to the fol lo wing: a) full name (first and last na mes whe re app li cab le); b) sex; c) date and pla ce of birth; d) na ti o na lity; e) any spe ci al phy si cal cha rac te ris tics that may as sist iden ti fi ca ti on; f) di gi tal or ori gi nal pho tog raph; and g) sig na tu re. 8. Not withs tan ding pa rag raph 7 abo ve, a temp la te or ot her rep re sen ta ti on of a bi o met ric of the hol der which me ets the spe ci fi ca ti on pro vi ded for in An nex I shall also be re qu i red for inc lu si on in the se a fa rers iden tity do cu ment, pro vi ded that the fol lo wing pre con di ti ons are sa tis fi ed:

4 7006 M A G Y A R K Ö Z L Ö N Y 2005/130. szám a) the bi o met ric can be cap tu red wit ho ut any in vas ion of pri va cy of the per sons con cer ned, dis com fort to them, risk to the ir he alth or of fen ce aga inst the ir dig nity; b) the bi o met ric shall it self be vi sib le on the do cu ment and it shall not be pos sib le to re cons ti tu te it from the temp la te or ot her rep re sen ta ti on; c) the equ ip ment ne e ded for the pro vi si on and ve ri fi ca ti on of the bi o met ric is user-fri endly and is ge ne rally ac ces sib le to go vern ments at low cost; d) the equ ip ment for the ve ri fi ca ti on of the bi o met ric can be con ve ni ently and re li ably ope ra ted in ports and in ot her pla ces, inc lu ding on bo ard ship, whe re ve ri fi ca ti on of iden tity is nor mally car ri ed out by the com pe tent aut ho ri ti es; and e) the sys tem in which the bi o met ric is to be used (inc lu ding the equ ip ment, tech no lo gi es and pro ce du res for use) pro vi des re sults that are uni form and re li ab le for the aut hen ti ca ti on of iden tity. 9. All data con cer ning the se a fa rer that are re cor ded on the do cu ment shall be vi sib le. Se a fa rers shall have con ve ni ent ac cess to ma chi nes enab ling them to ins pect any data con cer ning them that is not eye-re a dab le. Such ac cess shall be pro vi ded by or on be half of the is su ing aut ho rity. 10. The con tent and form of the se a fa rers iden tity do cu ment shall take into ac co unt the re le vant in ter na ti o nal stan dards ci ted in An nex I. Article 4 NATIONAL ELECTRONIC DATABASE 1. Each Mem ber shall en su re that a re cord of each se a fa rers iden tity do cu ment is su ed, sus pen ded or withd rawn by it is sto red in an elect ro nic da ta ba se. The ne ces sa ry me a su res shall be ta ken to se cu re the da ta ba se from in ter fe ren ce or una ut ho ri zed ac cess. 2. The in for mat ion con ta i ned in the re cord shall be rest ric ted to de ta ils which are es sen ti al for the pur po ses of ve ri fy ing a se a fa rers iden tity do cu ment or the sta tus of a se a fa rer and which are con sis tent with the se a fa rer s right to pri va cy and which meet all app li cab le data pro tec ti on re qu i re ments. The de ta ils are set out in An nex II he re to, which may be amen ded in the man ner pro vi ded for in Ar tic le 8 be low, ta king ac co unt of the need to give Mem bers suf fi ci ent time to make any ne ces sa ry re vi si ons of the ir na ti o nal da ta ba se systems. 3. Each Mem ber shall put in pla ce pro ce du res which will enab le any se a fa rer to whom it has is su ed a se a fa rers iden tity do cu ment to exa mi ne and check the va li dity of all the data held or sto red in the elect ro nic da ta ba se which re la te to that in di vi du al and to pro vi de for cor rec ti on if ne ces sa ry, at no cost to the se a fa rer con cer ned. 4. Each Mem ber shall de sig na te a per ma nent fo cal po int for res pon ding to in qu i ri es, from the im mig ra ti on or ot her com pe tent aut ho ri ti es of all Mem bers of the Or ga ni za ti on, con cer ning the aut hen ti city and va li dity of the se a fa rers iden tity do cu ment is su ed by its aut ho rity. De ta ils of the per ma nent fo cal po int shall be com mu ni ca ted to the In ter na ti o nal La bo ur Of fi ce, and the Of fi ce shall ma in ta in a list which shall be com mu ni ca ted to all Mem bers of the Or ga ni za ti on. 5. The de ta ils re fer red to in pa rag raph 2 abo ve shall at all ti mes be im me di a tely ac ces sib le to the im mig ra ti on or ot her com pe tent aut ho ri ti es in mem ber Sta tes of the Or ga ni za ti on, eit her elect ro ni cally or thro ugh the fo cal po int re fer red to in pa rag raph 4 abo ve. 6. For the pur po ses of this Con ven ti on, app rop ri a te rest ric ti ons shall be es tab lis hed to en su re that no data in par ti cu lar, pho tog raphs are ex chan ged, un less a me cha nism is in pla ce to en su re that app li cab le data pro tec ti on and pri va cy stan dards are ad he red to. 7. Mem bers shall en su re that the per so nal data on the elect ro nic da ta ba se shall not be used for any pur po se ot her than ve ri fi ca ti on of the se a fa rers iden tity do cu ment. Article 5 QUALITY CONTROL AND EVALUATIONS 1. Mi ni mum re qu i re ments con cer ning pro ces ses and pro ce du res for the is sue of se a fa rers iden tity do cu ments, inc lu ding qu a lity-cont rol pro ce du res, are set out in Annex III to this Con ven ti on. The se mi ni mum re qu i re ments es tab lish man da to ry re sults that must be achi e ved by each Mem ber in the ad mi nist ra ti on of its sys tem for is su an ce of se a fa rers iden tity do cu ments. 2. Pro ces ses and pro ce du res shall be in pla ce to en su re the ne ces sa ry se cu rity for: a) the pro duc ti on and de li ve ry of blank se a fa rers iden tity do cu ments; b) the cus to dy, hand ling and ac co un ta bi lity for blank and comp le ted se a fa rers iden tity do cu ments; c) the pro ces sing of app li ca ti ons, the comp le ti on of the blank se a fa rers iden tity do cu ments into per so na li zed se a fa rers iden tity do cu ments by the aut ho rity and unit res pon sib le for is su ing them and the de li ve ry of the se a fa rers iden tity do cu ments; d) the ope rat ion and ma in te nan ce of the da ta ba se; and e) the qu a lity cont rol of pro ce du res and pe ri o dic eva lu a ti ons. 3. Sub ject to pa rag raph 2 abo ve, An nex III may be amen ded in the man ner pro vi ded for in Ar tic le 8, ta king ac co unt of the need to give Mem bers suf fi ci ent time to make any ne ces sa ry re vi si ons to the ir pro ces ses and pro ce du res.

5 2005/130. szám M A G Y A R K Ö Z L Ö N Y Each Mem ber shall car ry out an in de pen dent eva lu a ti on of the ad mi nist ra ti on of its sys tem for is su ing se a fa rers iden tity do cu ments, inc lu ding qu a lity-cont rol pro ce du res, at le ast eve ry five ye ars. Re ports on such eva lu a ti ons, sub ject to the re mo val of any con fi den ti al ma te ri al, shall be pro vi ded to the Di rec tor-ge ne ral of the In ter na ti o nal La bo ur Of fi ce with a copy to the rep re sen ta ti ve or ga ni za ti ons of shi pow ners and se a fa rers in the Mem ber con cer ned. This re port ing re qu i re ment shall be wit ho ut pre ju di ce to the ob li ga ti ons of Mem bers un der ar tic le 22 of the Cons ti tu ti on of the In ter na ti o nal La bo ur Organisation. 5. The In ter na ti o nal La bo ur Of fi ce shall make the se eva lu a ti on re ports ava i lab le to Mem bers. Any disc lo su re, ot her than tho se aut ho ri zed by this Con ven ti on, shall re qu i re the con sent of the re port ing Mem ber. 6. The Go ver ning Body of the In ter na ti o nal La bo ur Of fi ce, ac ting on the ba sis of all re le vant in for mat ion in ac cor dan ce with ar ran ge ments made by it, shall app ro ve a list of Mem bers which fully meet the mi ni mum re qu i re ments re fer red to in pa rag raph 1 abo ve. 7. The list must be ava i lab le to Mem bers of the Or ga ni za ti on at all ti mes and be up da ted as app rop ri a te in for mat ion is re ce i ved. In par ti cu lar, Mem bers shall be promptly no ti fi ed whe re the inc lu si on of any Mem ber on the list is con tes ted on so lid gro unds in the fra me work of the pro ce du res re fer red to in pa rag raph In ac cor dan ce with pro ce du res es tab lis hed by the Go ver ning Body, pro vi si on shall be made for Mem bers which have been or may be exc lu ded from the list, as well as in ter es ted go vern ments of ra ti fy ing Mem bers and rep re sen ta ti ve shi pow ners and se a fa rers or ga ni za ti ons, to make the ir vi ews known to the Go ver ning Body, in ac cor dan ce with the ar ran ge ments re fer red to abo ve and to have any di sag re e ments fa irly and im par ti ally sett led in a ti mely man ner. 9. The re cog ni ti on of se a fa rers iden tity do cu ments is su ed by a Mem ber is sub ject to its comp li an ce with the mi ni mum re qu i re ments re fer red to in pa rag raph 1 abo ve. Article 6 FACILITATION OF SHORE LEAVE AND TRANSIT AND TRANSFER OF SEAFARERS 1. Any se a fa rer who holds a va lid se a fa rers iden tity do cu ment is su ed in ac cor dan ce with the pro vi si ons of this Con ven ti on by a Mem ber for which the Con ven ti on is in for ce shall be re cog ni zed as a se a fa rer wit hin the me a ning of the Con ven ti on un less cle ar gro unds exist for do ub ting the aut hen ti city of the se a fa rers iden tity do cu ment. 2. The ve ri fi ca ti on and any re la ted in qu i ri es and for ma li ti es ne e ded to en su re that the se a fa rer for whom ent ry is re qu es ted pur su ant to pa rag raphs 3 to 6 or 7 to 9 be low is the hol der of a se a fa rers iden tity do cu ment is su ed in ac cor dan ce with the re qu i re ments of this Con ven ti on shall be at no cost to the se a fa rers or shi pow ners. Sho re le a ve 3. Ve ri fi ca ti on and any re la ted in qu i ri es and for ma li ti es re fer red to in pa rag raph 2 abo ve shall be car ri ed out in the shor test pos sib le time pro vi ded that re a so nab le ad van ce no ti ce of the hold er s ar ri val was re ce i ved by the com pe tent aut ho ri ti es. The no ti ce of the hold er s ar ri val shall inc lu de the de ta ils spe ci fi ed in sec ti on 1 of An nex II. 4. Each Mem ber for which this Con ven ti on is in for ce shall, in the shor test pos sib le time, and un less cle ar gro unds exist for do ub ting the aut hen ti city of the se a fa rers iden tity do cu ment, per mit the ent ry into its ter ri to ry of a se a fa rer hol ding a va lid se a fa rer s iden tity do cu ment, when ent ry is re qu es ted for tem po ra ry sho re le a ve whi le the ship is in port. 5. Such ent ry shall be al lo wed pro vi ded that the for ma li ti es on ar ri val of the ship have been ful fil led and the com pe tent aut ho ri ti es have no re a son to re fu se per mis si on to come as ho re on gro unds of pub lic he alth, pub lic sa fety, pub lic or der or na ti o nal se cu rity. 6. For the pur po se of sho re le a ve se a fa rers shall not be re qu i red to hold a visa. Any Mem ber which is not in a po si ti on to fully imp le ment this re qu i re ment shall en su re that its laws and re gu lat ions or prac ti ce pro vi de ar ran ge ments that are subs tan ti ally equ i va lent. Tran sit and trans fer 7. Each Mem ber for which this Con ven ti on is in for ce shall, in the shor test pos sib le time, also per mit the ent ry into its ter ri to ry of se a fa rers hol ding a va lid se a fa rers iden tity do cu ment supp le men ted by a pass port, when ent ry is re qu es ted for the pur po se of: a) jo i ning the ir ship or trans fer ring to anot her ship; b) pas sing in tran sit to join the ir ship in anot her co unt ry or for re pat ri a ti on; or any ot her pur po se app ro ved by the aut ho ri ti es of the Mem ber con cer ned. 8. The Mem ber may also li mit the se a fa rer s stay to a pe ri od con si de red re a so nab le for the pur po se in qu es ti on. Article 7 CONTINUOUS POSSESSION AND WITHDRAWAL 1. The se a fa rers iden tity do cu ment shall re ma in in the se a fa rer s pos ses si on at all ti mes, ex cept when it is held for sa fe ke e ping by the mas ter of the ship con cer ned, with the se a fa rer s writ ten con sent. 2. The se a fa rers iden tity do cu ment shall be promptly withd rawn by the is su ing Sta te if it is as cer ta i ned that the se a fa rer no lon ger me ets the con di ti ons for its is sue un der this Con ven ti on. Pro ce du res for sus pen ding or withd ra wing se a fa rers iden tity do cu ments shall be drawn up in con sul ta ti on with the rep re sen ta ti ve shi pow ners and se a fa rers or ga ni za ti ons and shall inc lu de pro ce du res for ad mi nist ra ti ve appeal. Article 8 AMENDMENT OF THE ANNEXES 1. Sub ject to the re le vant pro vi si ons of this Con ven ti on, amend ments to the An ne xes may be made by the In ter na ti o nal La bo ur Con fe ren ce, ac ting on the ad vi ce of a duly cons ti tu ted tri par ti te ma ri ti me body of the In ter na ti o nal La bo ur Or ga ni za ti on. The de ci si on shall re qu i re a ma jo rity of two-thirds of the vo tes cast by the de le ga tes pre sent at the Con fe ren ce, inc lu ding at le ast half the Mem bers that have ra ti fi ed this Con ven ti on. 2. Any Mem ber that has ra ti fi ed this Con ven ti on may give writ ten no ti ce to the Di rec tor-ge ne ral wit hin six months of the date of the adop ti on of such an amend ment that it shall not en ter into for ce for that Mem ber, or shall only en ter into for ce at a la ter date upon sub se qu ent writ ten no ti fi ca ti on. Article 9 TRANSITIONAL PROVISION Any Mem ber which is a party to the Se a fa rers Iden tity Do cu ments Con ven ti on, 1958, and which is ta king me a su res, in ac cor dan ce with ar tic le 19 of the Cons ti tu ti on of the In ter na ti o nal La bo ur Or ga ni sa ti on, with a view to ra ti fi ca ti on of this Con ven ti on may no ti fy the Di rec tor-ge ne ral of its in ten ti on to apply the pre sent Con ven ti on pro vi si o nally. A se a fa rers iden tity do cu ment is su ed by such a Mem ber shall be tre a ted for the pur po ses of this Con ven ti on as a se a fa rers iden tity do cu ment is su ed un der it pro vi ded that the re qu i re ments of Ar tic les 2 to 5 of this Con ven ti on are ful fil led and that the Mem ber con cer ned ac cepts se a fa rers iden tity do cu ments is su ed un der this Convention. FINAL PROVISIONS Article 10 This Con ven ti on re vi ses the Se a fa rers Iden tity Do cu ments Con ven ti on, Article 11 The for mal ra ti fi ca ti ons of this Con ven ti on shall be com mu ni ca ted to the Di rec tor-ge ne ral of the In ter na ti o nal Labour Office for registration. Article This Con ven ti on shall be bin ding only upon tho se Mem bers of the In ter na ti o nal La bo ur Or ga ni za ti on who se ratifications have been registered with the Director-Ge ne ral. 2. It shall come into for ce six months af ter the date on which the ra ti fi ca ti ons of two Mem bers have been re gis te red with the Di rec tor-ge ne ral. 3. The re af ter, this Con ven ti on shall come into for ce for any Mem ber six months af ter the date on which its ra ti fi ca ti on has been re gis te red. Article A Mem ber which has ra ti fi ed this Con ven ti on may de no un ce it af ter the ex pi ra ti on of ten ye ars from the date on which the Con ven ti on first co mes into for ce, by an act com mu ni ca ted to the Di rec tor-ge ne ral for re gist ra ti on. Such de nun ci a ti on shall take ef fect twel ve months af ter the date on which it is re gis te red. 2. Each Mem ber which has ra ti fi ed this Con ven ti on and which does not, wit hin the year fol lo wing the ex pi ra ti on of the pe ri od of ten ye ars ment io ned in the pre ce ding pa rag raph, exer ci se the right of de nun ci a ti on pro vi ded for in this Ar tic le, shall be bo und for anot her

Article The Di rec tor-ge ne ral shall no ti fy all Mem bers of the re gist ra ti on of all ra ti fi ca ti ons, dec la ra ti ons and acts of de nun ci a ti on com mu ni ca ted by the Mem bers. 2. When no ti fy ing the Mem bers of the re gist ra ti on of the se cond ra ti fi ca ti on of this Con ven ti on, the Di rec tor-ge ne ral shall draw the at ten ti on of the Mem bers to the date upon which the Con ven ti on shall come into force. 3. The Di rec tor-ge ne ral shall no ti fy all Mem bers of the re gist ra ti on of any amend ments made to the An ne xes in ac cor dan ce with Ar tic le 8, as well as of no ti fi ca ti ons re lat ing the re to. Article 15 The Di rec tor-ge ne ral of the In ter na ti o nal La bo ur Of fi ce shall com mu ni ca te to the Sec re ta ry-ge ne ral of the Uni ted Na ti ons, for re gist ra ti on in ac cor dan ce with ar tic le 102 of the Char ter of the Uni ted Na ti ons, full par ti cu lars of all ra ti fi ca ti ons, dec la ra ti ons and acts of de nun ci a ti on re gis te red by the Di rec tor-ge ne ral in ac cor dan ce with the pro vi si ons of the pre ce ding Ar tic les. Article 16 At such ti mes as it may con si der ne ces sa ry, the Go ver ning Body of the In ter na ti o nal La bo ur Of fi ce shall pre sent to the Ge ne ral Con fe ren ce a re port on the wor king of this Con ven ti on and shall exa mi ne the de si ra bi lity of pla cing on the agen da of the Con fe ren ce the qu es ti on of its re vi si on in who le or in part, ta king ac co unt also of the pro vi si ons of Ar tic le 8. Article Sho uld the Con fe ren ce adopt a new Con ven ti on re vi sing this Con ven ti on in who le or in part, then, un less the new Con ven ti on ot her wi se pro vi des: a) the ra ti fi ca ti on by a Mem ber of the new re vi sing Con ven ti on shall ipso jure in vol ve the im me di a te de nun ci a ti on of this Con ven ti on, not withs tan ding the pro vi si ons of Ar tic le 13, if and when the new re vi sing Con ven ti on shall have come into for ce; b) as from the date when the new re vi sing Con ven ti on co mes into for ce, this Con ven ti on shall ce a se to be open to ra ti fi ca ti on by the Mem bers. 2. This Con ven ti on shall in any case re ma in in for ce in its ac tu al form and con tent for tho se Mem bers which have ra ti fi ed it but have not ra ti fi ed the re vi sing Con ven ti on. Article 18 The Eng lish and French vers ions of the text of this Con ven ti on are equ ally aut ho ri ta ti ve. Annex I Model for seafarers identity document The se a fa rers iden tity do cu ment, who se form and con tent are set out be low, shall con sist of go od-qu a lity ma te ri als which, as far as prac ti cab le, ha ving re gard to con si de ra ti ons such as cost, are not ea sily ac ces sib le to the ge ne ral pub lic. The do cu ment shall have no more spa ce than is ne ces sa ry to con ta in the in for mat ion pro vi ded for by the Con ven ti on.
