(..) on national frequency allocation and the rules of use for frequency bands by the Chairwoman of the National Media and Infocommunications Authority On the basis of the authorisation given by 82(3)(), (3), (5), (6), (8) and () of Act C of 2003 on Electronic Communications and proceeding within my competence as set forth in 09(5) of Act CLXXXV of 200 on Media Services and Mass Communications, I hereby decree as follows:. General provisions. () The scope of this decree shall cover a) for frequency bands within the radio spectrum up to GHz, aa) the allocation for radio services and joint civilian and non-civilian use, ab) the preparation, opening and restriction of use for radio services and radio applications, ac) the establishment of the rules for use, including frequency management requirements of radio systems, frequency management characteristics of radio equipment and conditions of use of bands related to individual permits and frequency use, ad) the establishment of use by high-frequency equipment, b) natural persons, legal persons and organisations without a legal personality requesting or using a frequency, or manufacturing, importing or distributing radio equipment or highfrequency equipment for use in Hungary, c) the National Media and Infocommunications Authority (hereinafter NMIA ) and the NMIA Office (hereinafter Office ). (2) The scope of this decree shall not cover the method of sharing frequencies for broadcasting purposes. 2. Explanatory provisions 2. () For the purpose of this decree the following definitions shall apply:. Harmonised NATO band type : a frequency band which is in general in military use in NATO Europe; 2. Harmonised NATO band type 2: a frequency band which is planned for military use in NATO Europe; 3. Harmonised NATO band type 3: a frequency band which has been identified for military use in NATO Europe; 4. Adaptive system: a radiocommunication system altering its radiotechnology characteristics according to channel quality; 5. Transmission: broadcasting produced by radio transmitting stations or the production of such broadcasting; 6. Transmission mode: the totality of the characteristics of transmission, that is, modulation mode of the main carrier wave, nature of the modulating signal, the type of information to be transmitted and, in certain cases, other additional characteristics, each of which is provided with a combination of standardised codes; 7. Active implantable medical device: any active medical device intended to be totally or partially introduced, surgically or medically, into the human body or by medical intervention into a natural orifice, and to remain after the procedure; 8. Active sensor: a measuring instrument used in Earth exploration-satellite and space research services, using which information may be obtained by way of transmitting and receiving radio waves;

Active medical implant: the part of any active implantable medical device which uses radio waves and is intended to be totally or partially introduced, surgically or medically, into the human or animal body or by medical intervention into a natural orifice, as well as any external auxiliary device thereof, if applicable; 0. Fixed station: a station in the fixed service;. Fixed service: a radiocommunication service between specified fixed points; 2. Non-transportable station: a station that can only be operated at a fixed installation site; 3. Animal-implanted device: a transmitter implanted in the body of an animal, used for diagnostic functions or ensuring that medical treatment is provided where intended; 4. Station: one or several transmitter or receiver or transmitter or receiver groups with accessories, with the purpose of implementing a radiocommunication or radio astronomy service at a given location; this concept includes the following stations: fixed station, nontransportable stations, amateur stations, repeater stations, base stations, base earth stations, onboard BTS, onboard communication systems, user stations, fixed stations, terrestrial stations, earth stations, land mobile stations, land mobile Earth stations, collection stations, ship stations, ship earth stations, ship's emergency transmitters, HAPS, land stations, land earth stations, HEST, standard frequency and time signal stations, port stations, experimental stations, coordinated stations, central stations, gateway earth stations, aeronautical stations, aeronautical earth stations, aircraft stations, aircraft earth stations, LEST, marker beacons, survival craft stations, mobile stations, mobile Earth stations, broadcasting stations, coast stations, coast earth stations, radio astronomy stations, radiobeacon stations, radio direction-finding, radiolocation land stations, radiolocation mobile stations, radiodetermination stations, radionavigation land stations, radionavigation mobile stations, SNG, Satellite Emergency Position-Indicating Radiobeacons, Emergency positionindicating radiobeacon stations, space stations, transportable stations, end-user stations, VSAT; 5. General application: all SRD applications regardless of application and purpose in particular, telemetry, remote control, alarm and general data transmission applications that fulfils the technical conditions required for the frequency band in question; 6. General multipoint system: a radio communication system operating in the fixed service where each user station is linked with the same station (central station) and there are user stations in the system between which direct radio link is also possible; 7. Amateur station: a station in the amateur service; 8. Amateur service: a radiocommunication service for the purpose of self-training, intercommunication and technical investigations carried out by amateurs, that is, by duly authorised persons interested in radio technique solely with a personal aim and without pecuniary interest; 9. Antenna gain: the proportion of the power at the input of a lossless reference antenna and the power at the input of the given antenna, usually expressed in db, at which both antennas produce the same strength or surface power density in a direction at the same distance; unless specified otherwise herein, antenna gain applies to the main radiation direction; antenna gain is applicable to a certain polarisation as well; depending on the choice of reference antennas, the following antenna gains exist: a) isotropic or absolute gain (G i ) where the reference antenna is a spatially insulated isotropic antenna, b) gain calculated for a half-wave dipole (G d ) where the reference antenna is a spatially insulated half-wave dipole whose equatorial plane includes the given direction, c) gain calculated for a short vertical antenna (G v ) where the reference antenna is a straight conductor well shorter than a quarter of a wavelength and is located perpendicularly at the plane perfectly conducting the given direction; 20. Material sensing device: a device enabling the application of radiodetermination, designed to locate objects in a material structure or to establish the physical characteristics of a material; 2

Repeater station: a station of significant importance that enables setting up radio links between the stations of a network within its coverage area, and is not itself a communications end-point; 22. Mean EIRP: the average EIRP for the period of the transmission stroke corresponding to the highest power, in case transmitter power is controlled; 23. Mean EIRP density: mean power measured at a given resolution bandwidth, using an RMS sensor and averaged for a given period of time; 24. Average power: for radio transmitter equipment, the average of power values that such equipment supplies to the antenna's power line under normal working conditions for an interval sufficiently long for the period of the lowest-frequency component of modulation; 25. Drive-in cinema application: a PMSE application used by cinema-goers via car radios as receivers for amplification, in which the film soundtrack is transmitted by an FM transmitter station; 26. Base station: a land station in the land mobile service; 27. Base earth station: an earth station in the fixed-satellite service or, in some cases, in the land mobile-satellite service, located at a specified fixed point or within a specified area on land to provide a feeder-link for the land mobile-satellite service.; 28. Inland waterway: an international or national waterway within the country borders, defined according to the Act on Waterway Transportation; 29. Internal space: internal space of buildings or other internal spaces where shielding usually provides sufficient attenuation to protect the other stations from harmful interference and help sharing with other radio services; 30. Inland waterway mobile service: a maritime mobile service that is extended to inland waterways; 3. BFWA system: a BWA system operated in fixed service; 32. Safety service: any radiocommunication service used permanently or temporarily for the safeguarding of human life and property; 33. Block management: management of frequencies of a frequency block within the framework of legal provisions and individual permits related to frequency use, including the planning, installation and ongoing operation of radio equipment or radio systems in consideration of other applications operated according to this decree in the band containing this frequency block. The Office will not inspect the planning or installation of radio equipment or radio systems in advance; 34. BMA: the use of a device sensing distortions in the electromagnetic field, designed to locate objects in a building structure or to establish the physical characteristics of a building material; 35. BWA system: a radio telecommunications system consisting of user stations and a system connecting the user stations to the core network, and the telecommunication between the stations is conducted with a broadband transmission capacity; 36. CGC: an integral part of a mobile-satellite system which consists of ground-based stations used at fixed locations and communicating with mobile earth stations, in order to improve the availability of the mobile-satellite system in geographical areas within the footprint of the system s satellite(s), where communications with one or more space stations cannot be ensured with the required quality; 37. Civilian self-defence organisation: an organisation established in an organisational form set forth in the act on civilian self-defence or the Act on the Right of Association, in order to protect the life and assets of the population; 38. CT: land mobile service part of an electronic communications network the base stations of which are directly connected to a public telephone network; 39. group communication needs: the needs of frequency users except for natural persons to communicate within and between groups. 40. group communication system: a radio telecommunications system fulfilling fixed and land mobile service needs and operated in a frequency band designated for the applications of both the fixed and land mobile service; 3

Peak EIRP density: the highest transmission level within the 50 MHz bandwidth around the frequency of the highest mean emitted power; if this value is measured at a bandwidth of x MHz then this level shall be decreased by a factor of 20lg(50/x) db; 42. Peak power: for radio transmitter equipment, the average of power values that such equipment supplies to the antenna's power line under normal working conditions for a radiofrequency period corresponding to the maximum amplitude of the modulation envelope; 43. Duplex system: a radiocommunication system operated in duplex mode; 44. Duplex distance: the difference of transmission and reception frequency for stations of a duplex system; 45. Duplex mode: an operating mode where transmission is possible through the telecommunication channel in two ways at the same time; 46. Individual permit: frequency allocation and radio permit; 47. Individual reception: reception of programmes of space stations in the satellite broadcast service using simple household equipment, in particular, equipment with small antennas; 48. Single sideband transmission: amplitude modulated transmission containing one of the two sidebands only; 49. EIRP: the product of the power supplied to the antenna and the antenna gain in a given direction relative to an isotropic antenna (absolute or isotropic gain); 50. Occupied bandwidth: the frequency bandwidth where each of the average powers emitted below the lower frequency limit and that emitted above the higher frequency limit is equal to the ß/2 percentage of the complete average power of the given transmission; unless an ITU-R recommendation stipulates otherwise, the ß/2 value shall be fixed at 0.5 %; 5. Primary radar: a radiodetermination system based on the comparison of reference signals with radio signals reflected from the position to be determined; 52. Primarily military use: use of a radio application pertaining to a given frequency band mainly by army and NATO users; 53. ERP: product of the power supplied to the antenna and the antenna gain calculated for a half-wave dipole in a given direction; 54. Onboard BTS: one or more mobile telecommunications station installed onboard aircraft, supporting the use of GSM 800 MCA systems; 55. Onboard communication station: a low-powered mobile station in the maritime mobile service intended for use for internal communications onboard a ship, or between a ship and its lifeboats and life-rafts during lifeboat drills or operations, or for communication within a group of vessels being towed or pushed, as well as for line handling and mooring instructions; 56. Half-duplex system: a radiocommunication system operated in half-duplex mode; 57. Half-duplex mode: a mode of operation where one end of a telecommunication channel operates in simplex mode and the other in duplex mode. 58. User station: a station in a radio telecommunications system that requires radio telecommunications terminal equipment to operate; 59. User management: the planning by the non-civilian frequency user of frequencies and frequency bands, use of the radio equipment used and the area of operation, as well as the operation of radio systems based on this; 60. Allocation: identical with the concept of frequency allocation as set forth in the explanatory provisions of Act C of 2003; 6. fixed station: a fixed station in the mobile service not assuming repeating or other central tasks; 62. Terrestrial station: a station providing for terrestrial radiocommunication; 63. Terrestrial radiocommunication: any radiocommunication other than space radiocommunication or radio astronomy; 4

Earth station: a station located either on the Earth's surface or within the major portion of the Earth's atmosphere and intended for communication: a) with one or more space stations; or b) with one or more stations of the same kind by means of one or more reflecting satellites or other objects in space; 65. Land mobile station: a mobile station in the land mobile service capable of surface movement within the geographical limits of a country or continent; 66. Land mobile earth station: a mobile earth station in the land mobile-satellite service capable of surface movement within the geographical limits of a country or continent; 67. Land mobile service: a mobile service between base stations and land mobile stations, or between land mobile stations; 68. Use of frequencies: generation, emission and reception of radio signals for radiocommunication or radioastronomy purposes; 69. Frequency user: a natural person, a legal person, an organisation having no legal personality or other organisation that/who generates radio signals or emits radio signals or operates radio equipment for radiocommunication purposes; 70. Character of frequency use: exclusive, shared or common according to the definitions of frequency in exclusive use, in shared use and in common use, respectively; 7. Frequency allocation plan: a plan concerning the use and channel arrangement of a frequency band related to a radio application, accepted internationally by the competent meeting and nationally by the Office; 72. Frequency tolerance: the highest allowed deviation between the centre frequency of the designated frequency and that of the frequency band occupied by a transmission, or the highest allowed deviation between the reference frequency of the transmission and its characteristic frequency, expressed in millionth parts or hertz; 73. FWA system: a radio system consisting of user stations and a system connecting the user stations to the core network, and where user stations can only be fixed; 74. Geostationary satellite: a geosynchronous satellite with a circular orbit in the plane of the Earth's equator, with a revolution direction similar to that of the Earth and, consequently, stationary with regard to the Earth; or a geosynchronous satellite approximately stationary with regard to the Earth; 75. Geostationary satellite orbit: a geosynchronous satellite with a circular orbit in the plane of the Earth's equator, with a revolution direction similar to that of the Earth; 76. Geosynchronous satellite: a satellite of the Earth with an orbit period equal to the period of the Earth's revolution around its own axis; 77. Vehicle: a complete, finished or incomplete self-propelled vehicle driven by an engine and with at least four wheels, with a highest planned speed exceeding 25 km/h, including trailers thereof which are wheeled vehicles without individual drive, designed and manufactured to be towed by a vehicle; 78. GSM system: an electronic communications network that complies with the national GSM standards, in particular MSZ EN :2002 and MSZ EN 30 5:2003 or equivalent regulations; 79. Collection station: a central station in the fixed service used for reception only; 80. Ship station: a mobile station in the maritime mobile service located onboard a vessel which is not permanently moored, other than a survival craft station; 8. Ship base station: a mobile picocell located on a ship and supporting GSM services in the band / MHz and / MHz; 82. Ship earth station: a mobile earth station in the maritime mobile-satellite service located onboard ship; 83. Ship movement service: a safety service in the maritime mobile service other than a port operations service, between coast stations and ship stations, or between ship stations, in which messages are restricted to those relating to the movement of ships. Messages which are of a public correspondence nature shall be excluded from this service; 84. Ship's emergency transmitter: a ship's transmitter to be used exclusively on a distress frequency for distress, urgency or safety purposes; 5

Hearing aid: a radio communications system which usually includes one or more radio transmitters and one or more radio receivers allowing persons with hearing disability to increase their hearing capability; 86. HAPS: a station located on an object at an altitude of km and at a specified, nominal, fixed point relative to the Earth; 87. Authorities' frequency list: a frequency allocation plan in a list based on any necessary coordination with the authorities competent with regard to a given radio application and published by the Office at the NMIA website; 88. HDFSS: a high bandwidth radio application in the fixed-satellite service, operating a high number of non-coordinated earth stations with small antennas within the implementing system; 89. Land station: a station in the mobile service not intended to be used while in motion; 90. Land earth station: an earth station in the fixed-satellite service or, in some cases, in the mobile-satellite service, located at a specified fixed point or within a specified area on land to provide a feeder-link for the mobile-satellite service; 9. HEST: in the band GHz or GHz (space-to-earth) and the band GHz or GHz (Earth-to-space), a non-coordinated Earth end-user station controlled by a satellite system and enabling digital transmission, with an EIRP greater than 34 dbw but not exceeding 60 dbw; 92. Transmission of news: transmission of audio and video information suitable for making a radio or a television programme, to the studio; 93. Standard frequency and time signal station: a station in the standard frequency and time signal service; 94. Standard frequency and time signal service: a radiocommunication service for scientific, technical and other purposes, providing the transmission of specified frequencies, time signals or both, of stated high precision, intended for general reception; 95. Administration: a definition set forth in Item 002 of the Annex to the ITU Constitution promulgated by Act XLV of the year 20 on the promulgation of the uniform structure of amendments made in Kyoto in 994, in Minneapolis in 998, in Marrakesh in 2002 and in Antalya in 2006 of the Constitution and Convention of the International Telecommunication Union signed at the Additional Plenipotentiary Conference (Geneva, 992) and the promulgation of the Optional Protocol signed at the Additional Plenipotentiary Conference (Geneva, 992); 96. ILS: a radionavigation system which provides aircraft with horizontal and vertical guidance just before and during landing and, at certain fixed points, indicates the distance to the reference point of landing; 97. ILS localiser: a system of horizontal guidance embodied in the instrument landing system which indicates the horizontal deviation of the aircraft from its optimum path of descent along the axis of the runway; 98. ILS glide path: a system of vertical guidance embodied in the instrument landing system which indicates the vertical deviation of the aircraft from its optimum path of descent; 99. Inductive application: a radio application using magnetic space of induction loop systems for near field communication, especially used for vehicle ignition inhibition, animal identification, alarm systems, cable sensing, waste management, personal identification, wireless speech transmission links, entry systems, proximity sensors, anti-theft systems (including radio-frequency anti-theft induction systems), data transfer to handheld devices, automatic goods identification, wireless control systems or automatic road toll collection; 00. ISM application: operation of equipment or appliances designed to generate and use locally radio-frequency energy for industrial, scientific, medical, domestic or similar purposes, excluding applications in the field of telecommunications; 0. ITS: systems and services, based on information and communications technologies, including processing, control, positioning, communication and electronics, that are applied to a road transportation system; 02. Characteristic frequency: an easily identifiable and measurable frequency of a given transmission; the carrier frequency may be designated as such; 6

Orbit of revolution: a trajectory of the mass centre of a satellite or other object in space mostly subject to the effect of natural forces and mainly gravity, related to a specific reference frame; 04. Low bandwidth system: a radiocommunication system of a channel bandwidth of 25 khz at maximum; 05. Port station: a coast station in the port operations service; 06. Port operations service: a maritime mobile service in or near a port, between coast stations and ship stations, or between ship stations, in which messages are restricted to those relating to the operational handling, the movement and the safety of ships and, in emergency, to the safety of persons. Messages that are of a public correspondence nature shall be excluded from this service; 07. Experimental station: a station not including amateur stations using radio waves for experiments conducted in order to develop science or technology; 08. Low filling factor, high reliability device: a radio equipment with generally low frequency use and relying on the rules related to low filling factor spectrum access, which provides for very reliable spectrum access and transmission in shared frequency bands; typically used in alarm systems and social alarm systems; 09. Low-power analogue FM transmitter: a radio application used to interconnect soundfrequency devices designated for personal use such as mobile phones and consumer electronics systems installed in vehicles or homes; 0. filling factor: the percentage of the time within any one-hour period during which radio equipment is actually in transmission mode;. Exclusively military use: use of a radio application pertaining to a given frequency band only by army and NATO users; 2. Frequency of exclusive use: a frequency that may be used in the area and during the time designated in an individual permit, without any time-sharing and with disturbance protection as established by the Office; 3. Coordination zone: when the necessity of coordination is established, an area surrounding an Earth station operating in the same frequency band as terrestrial stations or Earth transmitting stations operating in the same bidirectionally-shared frequency bands as receiving Earth stations, outside which disturbance may not exceed the level of allowed disturbance and therefore no coordination is needed; 4. Coordination distance: when the necessity of coordination is established, a distance measured in a given azimuth from an Earth station operating in the same frequency band as terrestrial stations or Earth transmitting stations operating in the same bidirectionally-shared frequency bands as receiving Earth stations, beyond which disturbance may not exceed the level of allowed disturbance and therefore no coordination is needed; 5. Coordinated Earth station: an Earth station authorised by the Office, with installation and transmission characteristics that have been coordinated against other stations previously authorised in the same coordination zone and of at least the same service category in order to avoid harmful interference; 6. Frequency in common use: a frequency that may be used by at least two frequency users at the same area any time. Traffic on such frequency by users is not regulated by the Office and no protection is provided against disturbances of frequency users by each other; 7. Community reception: reception of space stations of satellite broadcast services using occasionally complex receiving equipment with higher antennas than those used for individual reception and which are intended to be used by a public group at the same location or a distribution system supplying a specific area; 8. Central station: a station in point-to-multipoint and general multipoint systems which has a radio link established directly or through a repeater station with all user stations of these systems. If the system is connected to the core network or another system, the connection is established through this station; 9. Gateway earth station: a high capacity earth station equipped with a large antenna that operates in the space radiocommunication service and provides the transmission of information to geostationary and non-geostationary satellites; 7

8 20. Special service: a radiocommunication service, not otherwise defined, carried on exclusively for specific needs of general utility, and not open to public correspondence; 2. Footnote: the footnotes of the allocation table of RR frequency bands; 22. Aeronautical station: a land station in the aeronautical mobile service, including aeronautical stations located onboard ship or on a platform at sea; 23. Aeronautical earth station: an earth station in the fixed-satellite service, or, in some cases, in the aeronautical mobile-satellite service, located at a specified fixed point on land to provide a feeder-link for the aeronautical mobile-satellite service; 24. Aircraft station: a mobile station in the aeronautical mobile service, other than a survival craft station, located onboard an aircraft; 25. Aircraft earth station: a mobile earth station in the aeronautical mobile-satellite service located onboard an aircraft; 26. Aeronautical mobile service: a mobile service between aeronautical stations and aircraft stations, or between aircraft stations, in which survival craft stations may participate; emergency position-indicating radiobeacon stations may also participate in this service on designated distress and emergency frequencies; 27. Aeronautical radionavigation service: a radionavigation service intended for aeronautical purposes and for the safe operation of aircraft; 28. LEST: in the frequency band GHz or GHz (space-to-earth) and the frequency band GHz or GHz (Earth-to-space), a non-coordinated earth end-user station controlled by a satellite system and enabling digital transmission, with an EIRP not exceeding 34 dbw; 29. LT: a system used for general location tracking of persons and objects; 30. LT2: a system used for location tracking of persons and objects in industrial environment; 3. LTE system: an electronic communications network that complies with the national LTE standards, in particular MSZ EN , MSZ EN , MSZ EN and MSZ EN or equivalent regulations; 32. Marker beacon: a transmitter in the aeronautical radionavigation service which radiates vertically a distinctive pattern for providing position information to aircraft; 33. Secondary trading: identical with the concept of secondary frequency trading defined in the explanatory provisions of the NMIA decree on the secondary trading of radio frequencies; 34. Secondary radar: a radiodetermination system based on the comparison of reference signals with radio signals retransmitted from the position to be determined; 35. Maximum EIRP density: the highest signal strength measured at any frequency of a specific range in any direction; 36. MCA service: an electronic communication service provided by an undertaking to enable airline passengers to use public electronic communication networks during flight without establishing direct connections with terrestrial mobile networks; 37. MCV service: an electronic telecommunication service offered by an enterprise to persons onboard ships for the purpose of communication through the public electronic telecommunication network using GSM system not making direct contact with land mobile networks; 38. Allowed interference: observed or foreseen interference fulfilling the quantitative interference and sharing criteria set forth in the RR, the ITU-R recommendations or the separate agreements concluded according to the provisions of the RR; 39. Frequency of shared use: a frequency that may be used by at least two users based on an individual permit at the same area but at different times, with interference protection as stipulated by the Office; 40. Secondary wave radiation: a radiation at a frequency/frequencies outside the required bandwidth with a level that may be reduced without affecting adequate information transmission; secondary wave radiations include harmonic radiations, parasite radiations, intermodulation and mixing products but do not include broadcasts outside the band; 8

9 4. Secondary wave range: for a broadcast, the frequency range outside the range outside the band where secondary wave radiations typically dominate; 42. Survival craft station: a mobile station in the maritime mobile service or the aeronautical mobile service intended solely for survival purposes and located on any lifeboat, life-raft or other survival equipment; 43. Measurement device: a radio equipment forming part of a bidirectional radiocommunication system and enabling telecontrol, measurement and data transmission in an intelligent network infrastructure, in particular, electricity, gas and water supply; 44. Meteorological aids service: a radiocommunication service used for meteorological aids, including hydrological aids, observations and exploration; 45. Model control application: a radio application with the purpose of special remote control and remote measuring, and used to control remotely the movement of models (principally miniature representations of vehicles) in the air, on land or over or under the water surface; 46. Feeder-link: a radio link from an earth station at a given location to a space station, or vice versa, conveying information for a space radiocommunication service other than for the fixed-satellite service. The given location may be at a specified fixed point, or at any fixed point within specified areas; 47. Mobile station: a station in the mobile service intended to be used while in motion or during halts at unspecified points; 48. Mobile earth station: an earth station in the mobile-satellite service intended to be used while in motion or during halts at unspecified points; 49. Mobile service: a radiocommunication service between mobile and land stations, or between mobile stations; 50. MSI: navigational and meteorological warnings to ships, meteorological forecasts and other safety-related urgent messages; 5. Satellite: an object revolving around another object of a greater mass and whose movement is mainly and constantly determined by the gravity of that other object; 52. Inter-satellite service: a radiocommunication service providing links between artificial satellites; 53. Fixed-satellite service: a radiocommunication service between earth stations at given positions, when one or more satellites are used; the given position may be a specified fixed point or any fixed point within specified areas; in some cases this service includes satelliteto-satellite links, which may also be operated in the inter-satellite service; the fixed-satellite service may also include feeder links for other space radiocommunication services; 54. Amateur-satellite service: a radiocommunication service using space stations on earth satellites for the same purposes as those of the amateur service; 55. Land mobile-satellite service: a mobile-satellite service in which mobile earth stations are located on land; 56. Earth exploration-satellite service: a radiocommunication service between earth stations and one or more space stations, which may include links between space stations, in which a) information relating to the characteristics of the Earth and its natural phenomena, including data relating to the state of the environment, is obtained from active sensors or passive sensors on Earth satellites; b) similar information is collected from airborne or earth-based platforms; c) such information may be distributed to earth stations within the system concerned; d) platform interrogation may be included. This service may also include feeder links necessary for its operation; 57. Satellite network: a satellite system or a part of a satellite system, consisting of only one satellite and the cooperating earth stations; 58. Standard frequency and time signal-satellite service: a radiocommunication service using space stations on earth satellites for the same purposes as those of the standard frequency and time signal service. This service may also include feeder links necessary for its operation; 9

Aeronautical mobile-satellite service: a mobile-satellite service in which mobile earth stations are located onboard aircraft; survival craft stations and emergency positionindicating radiobeacon stations may also participate in this service; 60. Aeronautical radionavigation-satellite service: a radionavigation-satellite service in which earth stations are located onboard aircraft; 6. Meteorological-satellite service: an earth exploration-satellite service for meteorological purposes; 62. Mobile-satellite service: a radiocommunication service: a) between mobile earth stations and one or more space stations, or between space stations used by this service; or b) between mobile earth stations by means of one or more space stations. This service may also include feeder links necessary for its operation; 63. Broadcasting-satellite service: a radiocommunication service in which signals transmitted or retransmitted by space stations are intended for direct reception by the general public. In this service, the term direct reception shall encompass both individual reception and community reception; 64. Aeronautical mobile-satellite (OR) service: an aeronautical mobile-satellite service intended for communications, including those relating to flight coordination, primarily outside international and national civilian air routes; 65. Satellite link: a radio link between a transmitting earth station and a receiving earth station through one satellite. A satellite link comprises one up-link and one down-link; 66. Radiolocation-satellite service: a radiodetermination-satellite service used for the purpose of radiolocation. This service may also include the feeder links necessary for its operation; 67. Radiodetermination-satellite service: a radiocommunication service for the purpose of radiodetermination involving the use of one or more space stations. This service may also include feeder links necessary for its own operation; 68. Radionavigation-satellite service: a radiodetermination-satellite service used for the purpose of radionavigation. This service may also include the feeder links necessary for its operation; 69. Satellite system: a space system using one or more artificial earth satellites; 70. Aeronautical mobile-satellite (R) service: an aeronautical mobile-satellite service reserved for communications relating to safety and regularity of flights, primarily along international or national civilian air routes; 7. Maritime mobile-satellite service: a mobile-satellite service in which mobile earth stations are located onboard ships; survival craft stations and emergency position-indicating radiobeacon stations may also participate in this service; 72. Maritime radionavigation-satellite service: a radionavigation-satellite service in which earth stations are located onboard ships; 73. Transmission of programmes: transmission of audio and video information compiled and edited by a studio, for the purpose of broadcasting by a transmitting network; 74. Broadcasting station: a station in the broadcasting service; 75. Broadcasting service: a radiocommunication service in which the transmissions are intended for direct reception by the general public. This service may include sound transmissions, television transmissions or other types of transmissions; 76. MWA system: a radio system consisting of user stations and a system connecting the user stations to the core network, which may contain mobile user stations as well; 77. High-frequency equipment: a non-electronic telecommunication equipment for the purposes of an ISM application; 78. High filling factor device for continuous transmission: a radio equipment with low delay and used for high filling factor transmission, including private use, wireless, streaming audio and multimedia systems, mobile phones, vehicle or household consumer electronic systems, wireless speakers, wireless headphones, wearable portable radio equipment, hearing aids, monitoring headphones used at concerts and other stage performances, as well as low-power analogue FM radios; 0

11 79. NATO regulation: documents accepted by the competent body of NATO and regulating valid frequency use by NATO users, as well as applicable regulations of the NATO Unification Convention; 80. NATO user: a military organisation of a NATO Member State or another state participating in the Partnership for Peace programme promulgated in Act LXVII of the year 995; 8. NAVTEX: a system used for transmission and automatic reception using MSI narrowband direct-printing telegraphy; 82. NCU: an equipment installed onboard aircraft that increases the noise level in the reception frequency band of the mobile station to ensure that no signals emitted by land electronic mobile telecommunication systems in particular, GSM, UMTS, LTE and WiMAX may be received onboard; 83. Unwanted radiation: the combination of secondary wave radiation and radiation created by broadcasts outside the band; 84. National allocation: allocation of frequency bands for radio services and for civilian, non-civilian and combined use in Hungary with regard to RR regulations; 85. International allocation: the allocation of frequency bands in the three Regions, according to the RR (taking the individual frequency usage characteristics of each country into account) with the aim that administrations conform to the international rules when assigning frequencies; 86. NWA system: a radio system consisting of user stations and a system connecting the user stations to the core network, and where user stations can be fixed or mobile only; 87. Trunked system: a radiocommunication system with a high-frequency utilisation efficiency that operates at multiple radio frequencies, uses automatic channel selection, is capable of providing special transmission services (priority call, conference call, etc.) and its efficient operation is achieved by the design of its signalling and traffic system with regards to the aspects of use; 88. Public correspondence: a definition set forth in Item 004 of the Annex to the ITU Constitution promulgated by Act XLV of the year 20 on the promulgation of the uniform structure of amendments made in Kyoto in 994, in Minneapolis in 998, in Marrakesh in 2002 and in Antalya in 2006 of the Constitution and Convention of the International Telecommunication Union signed at the Additional Plenipotentiary Conference (Geneva, 992) and the promulgation of the Optional Protocol signed at the Additional Plenipotentiary Conference (Geneva, 992); 89. Tracking and asset tracing system: a system which allows the tracing and tracking of goods, leading to their recovery, consisting in general of an radio transmitter placed on the item to be protected and a receiver and may also include an alarm; 90. Aeronautical mobile (OR) service: an aeronautical mobile-satellite service intended for communications, including those relating to flight coordination, primarily outside international and national civilian air routes; 9. PAMR system: a network established exclusively for the purposes of electronic telecommunications services for dispatch purposes meeting group communication needs and used exclusively for providing services which is designed for dedicated user groups of business users but there is no limitation on the number, nature or type of the user groups and there is no need for these to be related; 92. Coast station: a land station in the maritime mobile service; 93. Coast earth station: an earth station in the fixed-satellite service, or, in some cases, in the maritime mobile-satellite service, located at a specified fixed point on land to provide a feeder-link for the maritime mobile-satellite service; 94. Coastal sea: a sea zone defined in the Convention on the Law of the Sea; 95. Passive sensor: a measuring instrument used in Earth exploration-satellite and space research services, using the information which may be obtained by way of receiving natural radio waves;

PMR system: in the mobile service, a radiocommunication system for providing closed user group communications which is used for its own purpose by enterprises and institutions, or partly allowed by the licensee to be also used by another user(s); 97. PMSE application: an application implemented using a wireless audio frequency PMSE equipment; 98. Point-to-point system: a radiocommunication system between two stations in the fixed service linked exclusively with each other for radiocommunication purpose; 99. Point-to-multipoint system: a radiocommunication system operating in the fixed service where each user station is linked directly or through a repeater station with the central station and there is no direct radio link between the user stations; 200. Radar: a radiodetermination system based on the comparison of reference signals with radio signals reflected or retransmitted from the position to be determined; 20. Radar beacon: a transmitter-receiver associated with a fixed navigational mark which, when triggered by a radar, automatically returns a distinctive signal which can appear on the display of the triggering radar, providing range, bearing and identification information; 202. Radio: a general term applied to the use of radio waves; 203. TRP: the integral of power emitted to all directions of space, determining actual emitted power of an antenna; 262. TTT application: a radio application implemented using a radiocommunication system used in (depending on applicable technical restrictions, road, railway, waterway or air) traffic, traffic control, navigation, mobility management and ITS that is typically used as connection points between different transport modes, connection between vehicles (in particular, cars), connection between vehicles and fixed points (in particular, cars and infrastructure), as well as bidirectional connection between frequency users UMTS system: an electronic communications network that complies with the national UMTS standards, in particular MSZ EN , MSZ EN , MSZ EN and MSZ EN or equivalent regulations; 264. UTC: time scale, based on the second (SI), as defined in Recommendation ITU-R TF For most practical purposes associated with the RR, UTC is equivalent to mean solar time at the prime meridian (0 longitude), formerly expressed in GMT; 265. UWB application: an application implemented using equipment employing UWB technology; 266. Equipment using UWB technology: equipment incorporating, as an integral part or as an accessory, technology for short-range radiocommunication, involving the intentional generation and transmission of radio-frequency energy that spreads over a frequency range wider than 50 MHz, which may overlap several frequency bands allocated to radiocommunication services; 267. Space station: a station located on an object which is beyond, is intended to go beyond, or has been beyond, the major portion of the Earth's atmosphere; 268. Space tracking: establishment of the orbit, speed or momentary position of an object in space using radiolocation but without the use of a primary radar for the purpose of tracking the movement of that object; 269. Space operation service: a radiocommunication service concerned exclusively with the operation of spacecraft, in particular space tracking, space telemetry and space telecommand. These functions will normally be provided within the service in which the space station is operating; 270. Space vehicle: a man-made vehicle intended to go outside the central part of Earth's atmosphere; 27. Space research service: a radiocommunication service in which spacecraft or other objects in space are used for scientific or technological research purposes; 272. Space radiocommunication: any radiocommunication involving the use of one or more space stations or the use of one or more reflecting satellites or other objects in space; 273. Space system: any group of cooperating earth stations and/or space stations employing space radiocommunication for specific purposes; 274. Space telemetry: telemetry used to transmit results of measurements made in space vehicles from space stations, including measurement results related to the operation of space vehicles; 275. Space telecommand: the use of radiocommunication for the purpose of transmitting radio signals to a space station that start, change or stop the operation of equipment installed on space objects pertaining to the space station or on the space station itself; 276. Operation: a process starting from installation up to and including ultimate termination of operation, including servicing maintenance and repair activities and pauses of operation; 277. Transportable station: a station that can be relocated but must be deployed at a fixed site in order to operate; 5

16 278. Railway vehicle: a vehicle according to Regulation (EC) No 9/2003 of the European Parliament and of the Council of 6 December 2002 on rail transport statistics; 279. End-user station: a user station which is an end-point of the electronic transmission; 280. Tender procedure: an auction or tender procedure used to share rights to use frequencies. 28. Wireless audio-frequency application: a radio application of streaming audio and multimedia systems, including wireless speakers, wireless headphones; portable wireless headphones used for, inter alia, wearable CD and cassette players or radio devices; wireless headphones used in vehicles and interoperating with radios, mobile phones, etc.; monitoring earbuds used at concerts and other stage performances; 282. Wireless audio frequency PMSE equipment: radio equipment used to transmit analogue or digital audio-frequency signals between a limited number of transmitter and receiver units, in particular, radio microphone, monitoring headphone system and audio transmission connection, mainly used for broadcast programmes or in the course of private or public social or cultural events; 283. Carrier power: the average of the power of a radio transmitter equipment that such equipment supplies to the antenna power line without modulation in one radio-frequency period; 284. Reference frequency: a frequency with a designated constant and accurately defined location with regard to the allocated frequency; the difference of this frequency from the allocated frequency has an absolute value and a sign like the characteristic frequency has with regard to the frequency band occupied by a broadcast; 285. VSAT: a fixed or transportable earth end-user station in the fixed-satellite service which has a small-sized antenna (of a diameter not larger than 2.4 m), a low antenna gain (not higher than 52 dbi) and a low EIRP density (not higher than 57 dbw/40 khz); 286. WAS: a broadband radiocommunication system that allows wireless access for public and private applications disregarding the underlying network topology; 287. WiMAX system: a point-multipoint system in the fixed service and a mobile radio communication system in the mobile service that has equipment with WiMAX type certificates issued by the WiMAX Forum; within the bands / MHz and / MHz, electronic telecommunication systems complying with the WiMAX national standards and, in particular, MSZ EN , MSZ EN and MSZ EN are also considered WiMAX systems; 288. Interference: the impact of unwanted energy due to broadcast, radiation, induction or any combination thereof on reception in a radiocommunication system, detected as reduced transmission quality or distortion or loss of information that could have been avoidable without the presence of such unwanted energy. (2) Other concepts related to frequency management and used herein shall be interpreted according to Act C of the year 2003 on electronic telecommunications (hereinafter Eht ). 3. Allocation of frequency bands 3. () The allocation of frequency bands specifies the possibilities of operation of radio services in both their international and national environments. Annex includes international allocation whereas Annex 2 includes national allocation. (2) According to RR, international allocation determines a) the allocation of frequency bands for radio services for the three geographical regions of the world, b) the allocation valid for Hungary, pertaining to Region, and c) the conditions according to RR, related to frequency use and indicated in footnotes. (3) Within the framework of international allocation, national allocation determines the frequency bands allocated in the territory of Hungary to radio services in accordance with their service categories, including allocation for civilian, non-civilian and combined use, 6

17 (4) According to this decree, in the territory of Hungary the frequency bands allocated to the maritime mobile service are also allocated to the inland waterway mobile service. In the territory of Hungary, the validity of the maritime mobile service as defined in the RR extends to the inland waterways as well. 4. () In frequency bands allocated for civilian use, frequency users not subject to the NMHH decree on the order of non-civilian frequency management (hereinafter Nr ) may request and use frequencies as set forth in the Eht and herein. (2) In frequency bands allocated for non-civilian use, organisations subject to the Nr may request and use frequencies as set forth in the Eht and herein. (3) In frequency bands allocated for civilian use, organisations subject to Nr whereas in frequency bands allocated for non-civilian use, frequency users not subject to Nr may obtain a frequency use right temporarily for a limited period of time for public interest events, cases and purposes that cannot be defined in advance following coordination of civilian and non-civilian frequency management requirements. (4) Organisations subject to Nr may also use radio application implemented in frequency bands allocated for civilian use if the stations thereof are exempt from the obligation of individual authorisation based on this decree. (5) Frequency use by NATO and NATO users in Hungary shall be considered non-civilian use with regard to military activities and civilian use with regard to broadcasting. (6) The frequency band allocated for combined use may be used for civilian and noncivilian purposes alike. In frequency bands allocated for combined use, a right to use a frequency may be obtained following coordination of civilian and non-civilian frequency management requirements. 5. () The service category determined in the allocation of frequency bands may be primary or secondary in terms of operation and interference protection of the station of such radio services. (2) Radio stations of a primary radio service: a) shall not cause harmful interference to radio stations of the same or other primary radio service(s); b) cannot claim protection from harmful interference from radio stations of the same or other primary radio service(s) to which frequencies are already assigned or for which a right of frequency use has been granted. (3) Radio stations of a secondary radio service: a) shall not cause harmful interference to radio stations of primary radio services for which aa) frequencies has been designated previously, ab) frequencies may be assigned at a later date, ac) frequency use rights have been obtained, or ad) frequency use rights may be obtained later; b) cannot claim protection from harmful interference from radio stations of other primary radio service(s) to which ba) frequencies has been designated previously, bb) frequencies may be assigned at a later date, bc) frequency use rights have been obtained, or bd) frequency use rights may be obtained later; c) can claim protection from harmful interference from radio stations of the same or other secondary radio service(s) to which ca) frequencies may be assigned at a later date, or cb) frequency use rights may be obtained later; d) cannot claim protection from harmful interference from radio stations of the same or other secondary radio service(s) to which da) frequencies has been designated previously, or db) frequency use rights have been obtained. 7

18 4. Rules for using frequencies 6. () Annex 2 sets forth the rules of using frequencies, which establish a) the radio applications and ISM application that may be implemented in Hungary in each frequency band according to their nature and possibility of use, b) applicable international and domestic documents, c) further rules of use. (2) The primary and secondary nature of use of radio applications are identical with those set forth in paragraphs (2) and (3) of 5. (3) Stations of radio application operated as tertiary services a) shall not cause harmful interference to radio stations of primary and secondary radio services or radio applications; b) cannot claim protection from harmful interference from radio stations of any radio service or radio application. 7. () A given frequency band (or frequency) may be a) assigned or b) planned in terms of the possibilities of putting into use by a radio application of the given frequency band. (2) In the frequency bands termed assigned, rights to use frequencies to install and operate stations of radio applications may be granted and stations of such radio application may be operated, provided the conditions and limitations specified are fulfilled. (3) The category planned is used to prepare the introduction of future radio applications in Hungary. In the frequency bands termed planned, rights to use frequencies to install and operate stations of radio applications specified may not be obtained and stations of such radio application may not be operated. (4) A station of a radio application may operate in a frequency band allocated to a given radio service only without causing harmful interference to radio applications of radio services in the directly adjacent frequency bands, with the width of the frequency band granted for the station in its individual permit taken into account. (5) Rights to use a frequency may be obtained according to the rules set forth in Annexes and 6 for onboard stations of maritime mobile service, aeronautical mobile service, radionavigation service, maritime mobile-satellite service, aeronautical mobilesatellite service and radionavigation mobile-satellite service and space stations of space telecommunication services for the purpose of use in international traffic and space. (6) For earth stations installed onboard ships in networks of the fixed-satellite service for the purpose of use in international traffic rights to use a frequency may be obtained based on the rules set forth in Annex, as well as Decisions ECC/DEC/(05)09, ECC/DEC/(05)0 and ECC/DEC/(3)0. 8. () Coordinated operation of radio systems may be ensured based on the frequency management requirements for the following characteristics: a) channel arrangement, including channel division, channel forming rules and guardband; b) transmission mode, modulation, occupied bandwidth; c) duplex direction, duplex distance; d) polarisation, and limits of characteristics, of emitted signals; e) transmission power, power density; f) minimum signal strength or input signal required to receive a signal; g) rules of channel access and channel occupation; or h) criteria related to protection from interference. (2) The following are the frequency management characteristics of radio equipment required to fulfil the basic requirements according to paragraph (2) of 80 of the Eht: a) transmitter characteristics: frequency deviation, frequency stability, power, power of adjacent channels, emission of secondary waves, intermodulation attenuation, recovery time, transient behaviour, modulation accuracy, filling factor; 8

19 b) receiver characteristics: highest usable sensitivity, same-channel selectivity, adjacentchannel selectivity, secondary wave selectivity, intermodulation selectivity, blocking or decrease of sensitivity, secondary wave radiation, multi-way sensitivity; c) antenna characteristics: antenna gain, direction accuracy, cross-polarisation attenuation, back-radiation attenuation, characteristics, secondary wave radiation of active antenna. (3) The conditions of band use related to authorisation and frequency use are classified in the following groups:. exemption from individual obligation of authorisation; 2. installation or operation based on individual permit, including a simplified radio permit and a radio permit obtained through a facilitated permission procedure; 3. the method of frequency allocation (order of arrival, tender procedure); 4. the purpose of a radio application; 5. possibility to provide electronic telecommunications services; 6. telecommunications characteristics of a radio application; 7. frequency allocation plans; 8. block management and the rules thereof; 9. user management and its rules; 0. regulations and restrictions related to the use of a radio application;. harmonised condition of a frequency band or frequency use of radio application; 2. executive provisions of international obligations; 3. preferences of obtaining a right to frequency use; 4. any possibilities and conditions of transferring rights to use a frequency; 5. any possibilities and conditions of renting out; 6. certain basic requirements as per paragraph (3) of 80 of the Eht of radio equipment. 9. () Unless the rules of using a frequency related to an application assigned to the given frequency band stipulate otherwise: a) limits of the technical characteristics specified by the manufacturer and the domestic distributor, as well as the regulations of RR and international professional organisations shall be valid; b) needs for frequencies shall be fulfilled in the order of arrival of requests, within the framework of individual authorisation procedures; c) stations used only for reception shall be exempt from the obligation of an individual authorisation except for civilian-use fixed and mobile stations and those for which the frequency user has reported a request for protection against harmful interference; d) no electronic telecommunications services may be provided in the given frequency band; e) secondary trading shall not be allowed. (2) It is required to report intentions of distributing radio equipment domestically according to the provision on radio equipment and electronic telecommunications endequipment and mutual recognition of their compliance or the NMHH decree on domestic distribution and compliance certification of radio equipment pertaining to the scope of noncivilian frequency management except for those in the list of radio equipment of radio applications with a harmonised frequency use. 0. () The following annexes include further details and additions to the rules of using frequencies set forth in Annex 2: a) Frequency management requirements and conditions of the band use of individual applications are included in Annex 3, b) International frequency coordination documents are included in Annex 4, c) The list of radio equipment of radio applications using harmonised frequencies is included in Annex 5. (2) Requirements of certain radio systems and radio equipment used outside Hungary and radio permits issued for international use are included in Annex 6. 9

20 (3) The interpretation of abbreviations used herein is included in Annex 7 whereas a list of international documents referred to herein is included in Annex Provisions concerning frequency use related to transfer and renting. () Unless otherwise stipulated herein, rights of use of frequency blocks or user blocks obtained as a result of tender procedures including concession tenders may only be transferred or rented only in their totality in terms of area, frequency and time. (2) In frequency bands where secondary trading is allowed, the right of frequency use may be transferred or rented if a) the party having obtained a right to use the frequency or an entitlement to benefits fulfils all conditions related to the original obtaining of such right of frequency use and set forth in the decision, authorities' agreement or individual permit establishing such right, and b) the Office approves of it. 6. Closing Provisions 2. This decree shall enter into force on the 5 th day following its publication. 3. This decree ensures conformity with:. Council Directive 87/372/EEC of 25 June 987 on the frequency bands to be reserved for the coordinated introduction of public pan-european cellular digital land-based mobile communications in the Community and the European Parliament and Council Directive 2009/4/EC amending it, 2. Council Directive 9/287/EEC of 3 June 99 on the frequency band to be designated for the coordinated introduction of digital European cordless telecommunications (DECT) into the Community, 3. Directive 999/5/EC of the European Parliament and of the Council of 9 March 999 on Radio Equipment and Telecommunication Terminal Equipment, and the Mutual Recognition of their Conformity, 4. Directive 2002/20/EC of the European Parliament and of the Council of 7 March 2002 on the Authorisation of Electronic Communications Networks and Services, 5. Directive 2002/2/EC of 7 March 2002 of the European Parliament and of the Council on a common regulatory framework for Electronic Communications Networks and Services; 6. Directive 2005/82/EC of the European Parliament and of the Council of 4 December 2005 repealing Council Directive 90/544/EEC on the frequency bands designated for the coordinated introduction of pan-european land-based public radio paging in the Community, 7. Directive 2009/40/EC of the European Parliament and of the Council of 25 November 2009 on the amendment of Directive 2002/2/EC on a common regulatory framework for Electronic Communications Networks and Services, Directive 2002/9/EC on Access to and Interconnection of Electronic Communications Networks and Associated Facilities and Directive 2002/20/EC on the Authorisation of Communications Networks and Services, 8.
